Chinese goods labelled made in Vietnam

At the end of 2019, Stewardesses Production and Trading Company Limited (address 558/66/27 Binh Quoi, Ward 28, Binh Thanh District, HCM City) opened a customs declaration form to import a shipment of neoprene pillows and fitted sheets without brand, 100% new from China, and the declared tax value was VND 230 million. The goods had C/O form E issued by China.

Detecting suspicious signs, the Import Cargo Customs Procedures Team, the Customs Enforcement and Supervision Team under the Sai Gon Seaport Customs Branch of Zone 1; the Customs Enforcement Team under HCM City Customs Department; the Investigation Police Division for Corruption, Smuggling and Economic Crimes-HCM City Police; and Border Guard of Sai Gon Seaport coordinated to conduct physical inspection for the shipment.

As a result, Customs detected thegoods were falsely declared, failed to declare and forged origin. Specifically, more than 3,000 products of fitted sheet were labelled in Vietnamese “design in French, made in Vietnam”. In addition, the company failed to declare 2,600 sets of sheets and 3,000 simili bags with zipper.

The total value of infringing goods was nearly VND 1.7 billion. Of which, the value of imported goods infringing origin was nearly VND 700 million, of undeclared goods nearly VND 1 billion, the increased tax difference was VND 500 million.

Thus, Stewardesses Production and Trading Company Limited imported goods bearing fake origin and production place labels. It violated Point e, Clause 8, Article 3 of the Government Decree No. 185/2013/ND-CP providing fines for administrative violations for producing and trading fake goods, banned goods and protectingconsumer rights; importing undeclared goods, leading to insufficient payable tax detected by customs authorities while implementing customs procedures.

Bogus director vacated business address

According to Customs News research, Stewardesses Production and Trading Company Limited (tax code 0315808658) was newly established and registered for the first time on July 23, 2019 and its headquarters were at 558/66/27 Binh Quoi, Phường 28, Bình Thạnh District, HCM City. The legal representative is Nguyen Thanh Hai as director.

After only a few months of establishment, the company imported the infringing shipment. Sai Gon Seaport Customs Branch of Zone 1 sent an invitation to the company but it has not sent its representative to work.

Investigating at the address of the company, the Police at Ward 28, Binh Thanh District, HCMCity said that there have no address 558/66/27 Binh Quoi, Ward 28, Binh Thanh District as registered in the business license of this company.

Verifying at the Department of Planning and Investment of HCM City, currently, Stewardesses Production and Trading Company Limited has not registered to dissolve; the tax branch of Binh Thanh District confirms the company no longer operates at its registered address.

Verifying at Nguyen Thanh Hai's current residence at 280/12A, DT743 Street, Binh Thang Ward, Di An Town, Binh Duong Province, Police of Binh Thang confirmed that in Binh Thang Ward, there has no address 280 / 12A Street DT743, Binh Thang Ward, Di An City, Binh Duong Province. For Nguyen Thanh Hai, the identity card No. 281154340, there wasno Nguyen Thanh Hai in the locality.

Based on the inspection results, Sai Gon Seaport Customs Branch of Zone 1 detected the act of the company showed signs of violationsofcriminal law for smuggling. Specifically, the company had a legal representative Nguyen Thanh Hai who intentionally imported goods with fake origin and place of production to deceive consumers, affecting State management policies, social order and security.

Sai Gon Seaport Customs Branch of Zone 1 has criminally prosecuted the case for smuggling and transferred the file of the case to the Investigation Police of HCMC Police.

Regarding the investigation on origin fraud, Sai Gon Seaport Customs Branch of Zone 1 has transferred the violation file of Super Foam Co., Ltd (address at Phu Chanh, Tan Uyen commune, Binh Duong) to the HCM City Police. This company imported three containers of fitted sheets from China. Through physical inspection, Customs detected 4,036 bags of fitted sheetslabelled “Made in Vietnam” “manufactured by Super Foam Vietnam Ltd” in three containers. It is likely that the three containers of goods forged Vietnamese origin will be illegally transshipped to the US toevade Chinese origin goods that are subject to high taxes.
