Prevent corruption and group interests in developing financial laws

VCN - In order to prevent corruption, group interests, and local interests, the Ministry of Finance requires its subordinate units to strengthen the building and perfecting legal system and law enforcement organization. Accordingly, the Ministry will strictly handle corruption, negative acts and group interests in policy development.

Strictly handling documents that provide illegal regulations

Accordingly, the Ministry of Finance directs the units to strengthen discipline in formulating and promulgating legal documents, strictly implement Regulation No. 69-QD/TW dated July 6, 2022 of the Politburo on disciplining organizations and party members for violations. It is forbidden to direct or promulgate institutions, mechanisms and policies that have contents inconsistent with the Party's policies and regulations, State laws for group and local interests.

The Ministry of Finance (MoF) requires the units to proactively propose to develop legal documents in accordance with regulations. During the making a proposal to develop a document, the units need to review and assess the practical status and the impact of the policy.

The MoF requires the units to strengthen policy communication in making proposals to develop legal documents to create consensus of society and people and ensure conditions for the Vietnam Fatherland Front, people, and businesses to participate in the development and promulgation of legal documents.

During drafting documents, the units need to closely follow the Party's policies and the legal policies of superiors, strictly comply with the order, procedures, and deadlines for drafting; strengthen control the issuance of documents under simplified procedures and processes.

In addition, the units need to fully review and strengthen the proposal of a document to regulate many contents of laws, ordinances, and resolutions to limit the issuance of many documents detailing implementation, ensuring ensure the unity of the legal system, and facilitate the enforcement process.

Promptly detect illegal content and propose drastic measure

The MoF sets many requirements for the review and inspection of documents. Accordingly, the Ministry requires heads of the units to determine the checking and reviewing legal documents as the regular and continuous task.

The Ministry also asks the heads to promote self-inspection to promptly identify and rectify difficulties and limitations in implementing legal documents; further enhance responsibility, order and discipline in building and enforcing the law.

Promptly detect and handle overlapping, and inconsistent legal regulations to ensure unity of the legal system, remove difficulties and obstacles, and promote development, especially strictly handle detected documents containing illegal regulations, prevent the documents providing illegal regulations that negatively impact the interests of the State, legitimate rights and interests of individuals and organizations.

It is necessary to strengthen inspection for legal documents issued by ministries, branches and localities that have contents under the management of the Ministry of Finance to promptly detect illegal regulations and recommend handling measures.

In the law enforcement, it is necessary to improve the effectiveness and efficiency of law enforcement organization; promote the supervision of law enforcement. Focus on implementing dialogues with businesses and people about problems and obstacles in implementing policies and laws.
