Decree 119/2018/ND-CP on e-invoice was issued and will take effect from November 1, 2020. To provide detailed instructions on e-invoices, the Ministry of Finance issued Circular 68/2019/TT-BTC to instruct Decree 119.
According to the General Department of Taxation, from November 1, 2018 to October 31, 2020, the tax authority will notify conversion to business establishments to apply e-invoices according to Decree 119 and Circular 68. However, if the business establishments have not yet met information technology infrastructure and continue to use paper invoices, they must send invoice data to tax authorities and submit VAT declarations. Based on this data, tax authorities will develop invoice data of production and business establishments to update it into the invoice database and post it on the portal of the General Department of Taxation.
Also, the General Department of Taxation said for public non-business organisations (public educational institutions, public health establishments) that have used receipt, they shall continue to use them. If the tax authority notifies the conversion into e-invoice with codes of the tax authority to the organisations, but their IT infrastructure has not been eligible, paper invoice and receipts.
If public non-business units are eligible for e-invoices, they shall register to use e-invoice with codes of tax authorities or e-invoices without codes of tax authorities as per provisions of Article 8 and Article 13 of Circular 68/2019 / TT-BTC.
Recently, at a dialogue conference on Tax and Customs policies, Deputy Minister of Finance Tran Xuan Ha said although Decree 119 and Circular No. 68/2019/ TT-BTC were issued, however the Law on Tax administration No. 38 that have been issued, specifies some new contents on e-invoices and e-documents. Accordingly, the National Assembly has assigned the Government to provide detailed guidance on e-invoices and e-documents.
The Ministry of Finance will have to develop a decree to submit to the Government to replace Decree 119. The contents of Circular No. 68 which provides administrative procedures will be upgraded to a decree to provide specific guidance, including provisions on the implementation of e-invoices in some cases such as how to make receipt for payment of electricity and water, and how to declare and pay taxes reasonably.
