Government Decree 01/2017 allowing to grant certificates of land use rights, house ownership rights and assets attached to land for 5 more cases, including cases of expanded lands andillegallands before July, 2014

Time for granting certificate of land use rights is to be shortened, illegal lands and expanded lands are also granted the certificate, subject to open accounts are extended and expectations for university admissions are not limited, etc, are new prominent policies which take effect from March 1, 2017

Granting of land use right certificates is less than 15 days

From March 3, 2017, Government Decree 01/2017 amending and supplementing some decrees detailing the implementation of the Land Law will take effect. Time for many administrative procedures in the field of land will reduce half or 1/3 compared to the previous regulations.

Specifically, the registration and granting of certificates of land use rights, house ownership and other assets attached to the land for transferee of the land use rights, house ownership, construction work of construction investment organizationsdo not exceed 15 days instead of 30 days as in the previous regulations.

The registration and granting of certificates of land use rights, house ownership and other assets attached to land is also to be reduced to 15 days instead of 20 days as before

Particularly, procedures for granting of certificates of land use rights and house ownership andlost certificates of construction work ownership are to be decreasedby 2/3of time to 10 days instead of 30 days.

In addition, the decree permits the granting of certificates of land use rights, house ownership and assets attached to land to be extended in5 more cases: Family households and individuals using illegal lands before July 1, 2014; land allocated not in accordance with power; and an area of land increased against the Document of land use right issued fora family household and individuals who are currently using the land; land for urban construction and rural residential areas, business and production areas with many different purposes, and the cases where the land use right has been transferred but the name has not been changed.

Persons aged 15 are permitted to open payment account

This is new content prescribed in Circular No. 32/2016 of the State Bank, which takes effect from March 1, 2017 and amends the Circular 23/2014 guiding the opening and use of payment accounts at payment service suppliers.

Accordingly, the Circular amends and supplements subjects to open payment accounts at banks and foreign bank branches as below:

Persons fromage of 15 and under age of 18, not losing or being restricted in civil act capacity, who are not required to have own assets to ensure the obligation implementation in opening a payment account as per current regulations.

Besides, the Circular also adds persons who have difficulties in awareness and master of their acts under the Vietnam law, may open payment accounts through their guardian.

There must be at least an emergency station for each 50 km on highways

The Circular No. 49/2016 of the Ministry of Health regulated the emergencyorganization and operationsof traffic accidents on the highways.

Accordingly, the emergency operations of traffic accidents must be quick, timely and effective to rescue and transport victims to the nearest medical examination and treatment establishment.

The network of establishments for rescue operations on highways includes emergency stationswhich are organized as below:

The emergency stations are integrated with available medical examination and treatment establishments on highways including commune’s and ward’s medical stations; district’s medical examination and treatment centers; 115 emergency centers and State hospitals and private hospitals.

There must be at least one emergency station for each 50km on highways. This Circular takes effect from March 1, 2017.

Electronic transactions in Insurance

Decree 166 / CP on electronic transactions in social insurance, health insurance and unemployment insurance takes effect from March 01, 2017. People can register electronic transactions in the fields of insurance, book issuance, settlement and payment of insurance benefits; assessment and payment for medical examination treatment costs with health insurance and exchange of information related to the implementation of insurance regime.

The Decree also specifies the cases of electronic social insurance document submissionby electronic transactions via the electronic portal of Vietnam Social Insurance or Organization I-VAN for 24 hours a day and 7 days aWeek.

The receiving agency will electronically send a confirmation message to the e-mail address of the applicant within 15 minutes after receivingelectronic social insurance documents.

Expectations for undergraduate admission are not limited

According to Circular 04/2017 on regulations on national high school exams, consideration for recognition of high school graduation and Circular 05/2017 of the Ministry of Education and Training on regulations on full time undergraduate admission and full-time college admissions for teacher training, which take effect from March 10, 2017, the regulations on high school exams and undergraduate admission in 2017 have many new remarkable points as below: change in number of high school tests, and five tests replacing 8 examination as before.

Specifically, there are three independent exams on Mathematics, Foreign Languages and Literature; two combined exams including one natural science exam composed of Physics, Chemistry and Biology, and one social science exam composed of History, Geography and Social Science for national high school students and composed of History and Geography for continuing education students.

Meanwhile, Circular 05 stipulates that students who registered undergraduate admissions are not limited by the number of expectations and number of universities, and the expectations are sorted in order of high to low priority.
