Tax exemption for imported goods for investment projects – changed time criteria

It was an answer of the General Department of Customs to Dong Nai Customs Department about extending the execution time of the list of tax exemption for Greenfeed Vietnam Co Ltd. – Dong Nai Branch. This company has expired the expected import period but not yet finished.
The General Department of Customs stated that, they have issued a document to discuss with the Ministry of Planning and Investment about this case. Accordingly, the enterprise may continue to import without tax assessment if they satisfy these conditions: Enterprises present certificates of adjusted investment that clarify the project schedule; Enterprises implement the adjustment about expected import period on the list of imported goods without tax assessment; Enterprise imported the rest of tax exemption goods under the list of imported goods without tax assessment, follow the extension and report the situation of using import goods without tax assessment under the provisions of Article 106 of Circular 38/2015 / TT-BTC.
Besides that, the General Department of Customs requested Dong Nai Customs Department to conduct post clearance audit for the imported goods which has tax exemption of Greenfeed Vietnam Co Ltd. – Dong Nai Branch.
In case if the enterprise is detected as not being a subject to have tax exemption, and imports exceed the demand of their project as well as using tax exemption goods with wrong purpose, the enterprise will be pay tax and be handled in accordance to the law.
