Simplifying administrative procedure in State Treasury field

The Draft is developed to review, improve, simplify and standardize administrative procedures in the State Treasury field, and meet requirements on the control of State revenue collection and payment under the Law on State budget 2015, Law on fee and charge 2015, Law on Construction 2014 and other relevant legal documents, and in accordance with the actual IT application in agencies and units as well as orientations on procedure reform and innovation.

At the same time, prevent the issue of new or complicated administrative procedures compared to the procedures stipulated in current Circulars of the Minister of Finance; review to abolish some procedures which were publicized but are not in accordance with new provisions or the reality.

Besides, administrative procedures are also reformed, simplified, standardized and publicized, and meet requirements on the control of State revenue collection and payment promptly, strictly and effectively and facilitate relevant individuals and organizations. Thereby, reducing the time of State revenue payment to 5 minutes/ transaction (previously about 30 minutes), reducing time of controlling investment expenditure from 7 days to 3-4 working days.

However, besides achievements, the provision and implementation of administrative procedures in the State Treasury also have shortcomings such as: some administrative procedures were issued and have been implemented, but they need to be reviewed to amend and supplement or be newly issued in accordance with new legal documents and management mechanism (for example administrative procedures on payment of State investment capital for the implementation of national target programs for 2016-2020, the control of State expenditure via the State Treasury under the new provisions of the law on State budget 2015 and Law on Public Investment 2014).

The administrative procedures for receiving and storing precious assets and valuable papers at the State Treasury and the administrative procedures for giving precious assets and the valuable papers to the State Treasury, which are no longer appropriate (because the fee for storage and management of these assets are not specified in the list of fees and charges in accordance with the Law on Charges and Fees in 2015), should be abolished.

According to the Ministry of Finance, the amendments are to meet the requirements on administrative procedures in the State Treasury field in accordance with provisions in Law on Promulgation of Legal documents 2015 and new provisions in the field of the State revenue collection and payment via the State Treasury; meet requirements on administrative procedure reform and IT application under the Government’s policies. In addition, in order to remove difficulties and shortcomings in carrying out administrative procedures in the State Treasury field, it is necessary to develop and issue a Decree stipulating general administrative procedures.

Therefore, developing a sufficient and unified legal framework for the implementation as well as restricting the issue of a large number of Decrees therein after in case of the Ministry of Finance’s proposals for amendment and supplements to the current Circulars stipulating administrative procedures in the State Treasury field.
