Review, perfect regulations on decentralization of public property management

Implementing the Law on Management and Use of Public Property in 2017, the Ministry of Finance has submitted to the Government 19 decrees and one resolution, and the Prime Minister on issuing one decision, the Ministry of Finance promulgated 12 circulars under its competence to detail and guide the implementation of the law.

To further improve regulations on management and use of public property under the authority of ministries, central and local agencies as a legal basis for the implementation, the Ministry of Finance requests ministers, heads of central agencies, People's Councils of provinces, People's Committees of provinces, chairmen of People's Committees of provinces regularly review and perfect regulations on decentralization of public property management according to Decree No. 151/2017/ND-CP dated December 26, 2017 of the Government detailing a number of articles of the Law on Management and Use of Public Property;

At the same time, to decentralize authority to issue standards and norms for the use of specialized public property (area of non-business works belonging to non-business establishments, special-use cars, specialized machinery and equipment under their management), according to Decree No. 152/2017/ND-CP dated December 27, 2017 of the Government stipulating standards and norms for the use of working offices, non-business establishments, Decree No. 04/2019/ND-CP dated January 11, 2019 of the Government stipulating standards and norms for the use of cars, Decree No. 85/2018/ND-CP dated May 30, 2018 of the Government regulations on standards and norms for the use of cars at units of the People's Armed Forces and the Prime Minister's Decision No. 50/2017/QD-TTg, dated December 31, 2017 stipulating standards and norms for the use of machinery and equipment..

The Ministry of Finance also requires ministries, central and local agencies to decentralize the authority to pass decisions on the establishment of the entire people's ownership of property and to decentralize the authority to approve plans for handling of property subject to the establishment of the entire people’s ownership according to Decree 29/2018/ND-CP of the Government stipulating the order and procedures for establishing the entire people's ownership of property and handling the property established for the entire people's ownership and other decentralization contents, as specified in documents detailing the implementation of the Law on Management and Use of Public Property.

The decentralization ensures compliance with the provisions of law (law on management and use of public property, law on promulgation of legal documents, law on government organization, law on organization of local government) and the actual situation.

The Ministry of Finance also asks ministers, heads of central agencies, provincial People's Councils, Provincial People's Committees, and head of Provincial People's Committees to direct the strengthening of inspection and examination of the management and use of public property to ensure the decentralization effectively, avoid loss, waste, and violation of the law on management and use of public property; and promptly detect problems and inadequacies to proactively solve according to their competence or report to competent authorities for settlement.
