Public property management creates a source of revenue for State Budget

Approving the plan on rearrangement and handling of 1,402 houses and land establishments

Assessing the situation of management and use of public property in 2021, the Ministry of Finance said the ministry has established a relatively complete and synchronous legal system in order to perform the task of public property management.

The regulations on public property management identify the subject which is assigned to manage and use of each type of public unit attached with the right and obligation of collective, individual, head of the office, organisation, units in the management and use of public property; building system of the standard and usage quota of public property attached with the responsibility of checking the compliance with standards and norms in the entire process of public property management.

Along with that, it created a mechanism of assignment and decentralization of public property management in accordance with the level of socio-economic development, the nature of public property management and use, and the management capacity of all levels, sectors, localities and units.

The management and use of public property since the introduction of the Law on Management and Use of Public Property has been implemented by all levels and local authorities, contributing to the implementation of the objectives of preventing and combating corruption and waste, improving efficiency in the management and use of public property.

In particular, the management of public property has created a source of revenue for the state budget, contributing to the performance of the state's budgetary-financial tasks, especially ensuring the budget balance of local governments at all levels through revenues from exploiting and handling public property, revenue from land allocation, land lease, and land use.

It is estimated that the total annual revenue from houses and land accounts for about 12% of total state revenue. Particularly, in 2021, the revenue from land is estimated at nearly VND200 trillion.

Regarding the management and use of the office and rearrangement and handling of houses and land, in 2021, the Ministry of Finance said that it has approved a new plan to rearrange and handle 1,402 houses and lands; approved the adjustment of the handling plan for 149 houses and lands of ministries and central agencies. By November 30, 2021, the Ministry of Finance approved a plan to rearrange and handle 29,564 houses and land areas of ministries and central agencies.

Promote the rearrangement and handling of houses and land

Regarding limitations and shortcomings in the management of public property, the Ministry of Finance said that the system of legal documents on the management and use of public property is still incomplete; the mechanism of decentralization of public property management still has some inappropriate points, especially the mechanism of decentralization of authority in deciding to sell houses, transfer land use rights, recover houses and land from central agencies; the management and use of public property is sometimes not strict, especially the use of public property for the purposes of a joint venture, association, leasing; slow progress of rearranging and processing houses, land, and cars; the inspection, examination, audit and supervision of the competent authorities have not been regular, complete and timely, the detection of errors in the management and use of public property is still limited, leading to difficult and complicated consequences.

Regarding this issue, according to Mr. Nguyen Tan Thinh, Director of the Public Asset Management Department (Ministry of Finance), the sanctions for violations in the management and use of public property have basically been established in a relatively complete, synchronous and deterrent manner.

The problem is in the implementation stage of ministries, sectors and localities. To solve this problem, the Ministry of Finance has submitted to the Prime Minister for promulgation Directive No. 32/2019/CT-TTg, which requires ministries, sectors and localities to strengthen inspection and examination, promptly and strictly handle violations in the management and use of public property; strictly implement Decree No. 63/2019/ND-CP stipulating penalties for administrative violations in the field of management and use of public property; practicing thrift and combating waste, etc.

In addition, the Ministry of Finance has also issued many documents urging and warning about the use of public property for business purposes, leasing, joint ventures, association, and collective procurement.

The Public Asset Management Department is studying and advising the Ministry of Finance on issuing documents to recommend ministries, sectors and localities to strengthen the work of disseminating and communicating the law on handling of violations in the field of management and use of public property.

In 2022, the key tasks and solutions to implement the management and use of public property have been set out by the Ministry of Finance.

Accordingly, perfecting the law on management and use of public property is the priority task. Along with that, conducting an evaluation of the implementation of documents detailing the fulfillment to report to the competent authorities in order to complete the mechanism, policies and organize the implementation to ensure strict management, effective exploitation of resources from public property, especially issues related to car usage standards, using public property for leasing, joint ventures and association purposes.

Furthermore, the Department also promotes the rearrangement and handling of houses and land as public property, prioritizes the arrangement of houses and land of enterprises and units that are on the list of equitization; guiding ministries, sectors and localities to review and inspect the implementation of the reorganization and handling plan that is approved by competent authorities in order to speed up the implementation progress, promptly detect, rectify and handle violations (if any).

In addition, closely grasping the situation of the Covid-19 pandemic to provide solutions to extend, postpone, exempt and reduce land rent to remove difficulties for production and business activities, contributing to the implementation of the scheme on economic recovery and development.
