According to enterprises, from the beginning of 2014, the Government had many solutions, and directed authorities to accelerate the operation of vehicle weight inspecting on a national scale in order to control overloaded transport vehicles to protect the lives and property of people, and protecting the road infrastructure. The policy of the Government is correct, gaining the sympathy and support of public opinion and transport enterprises. However, according to the analysis of transport companies, the regulations of the Ministry of Transport to control semi-trailers is inconsistent with objective reality, causing difficulties, increasing costs for businesses, wasting thousands of billions of vnd for society

The fact proves that, for more than two years of controlling semi-trailers, thousands of 20 feet, 2 axel, and 3 axel semi-trailers have been turned into scrap, costing transport enterprises thousands of billions of vnd in tough times. Putting semi-trailers for modification (adjusting pull latch or cluster shaft) takes time, and many companies do not have the capability to modify semi-trailers. The few remaining companies which have capability to modify semi-trailers are always busy and transport companies must register in advance, waiting for modifications to be made. It is absurd that the new regulations were enacted to not only modify old semi-trailers but also the fully new invested semi-trailers, being modified to qualify to carry a container with international standard weight (30.480kgs). Many semi-trailers are completely modified but can not be used, or are useable but do not ensure traffic safety. 3,640 Class 3-axel semi-trailers have been modified causing difficulties, inconvenience and cost for businesses; 3,465 2 axel semi-trailers and hundreds of 20 feet semi-trailers in the market have been turned into waste due to insufficient capacity to transport international standard containers (30,480 kg) as before. According to calculations by enterprises, 3,465 2-axel semi-trailers were discarded into scrap which wasted 1,039 billion vnd.

In addition, transport enterprises think that regulations on the calculation of the load applied for semi-trailer/prime mover combinations which specialize for carrying containers, bulk and steel, are not compatible with reality, causing difficulties for enterprises during operation. Due to the unique nature of specialized combination vehicles carrying containers, companies recommend the Government issues a Resolution to stop applying sanctions against drivers, owners of transport companies, and vehicle owners who directly control transport vehicles with axel load (including the goods loaded on the vehicle and the truck) which exceeds the load for bridges and roads prescribed in Clause 3, Paragraph 4, Section 5, point a of Paragraph 6, Article 33 and Article 30 of Decree 46/2016/ND-CP dated on 26-5-2016, effective from 1-1-2017. Proposing the Government to modify some articles of Decree 46/2016/ND-CP dated on 26-5-2016 onwards: only sanction drivers and combination vehicles pulling 5 or 6 axel semi-trailers carrying over the total weight(full volume) of the vehicle which exceeds the regulation; and modifying and supplementing the Decree to reduce the sanctions imposed on drivers and enterprises who violate the axel overload by 25% or more.
