This Decree provides for standards and norms for the use of cars; fix expenditure for the use of cars; the car rental services and rearrangement and handling of cars including: cars for titles; cars for general work; specialized cars; cars for state reception.

In particular, the Decree specifies titles which are allowed to regularly use cars, even when they are retired with unspecified prices: General Secretary of the Party Central Committee; President; Prime Minister; Chairman of the National Assembly .

Cadres with titles as Politburo member, Secretary of the Party Central Committee, Vice President, Deputy Prime Minister, Vice Chairman of the National Assembly, Chairman of the Central Committee of the Vietnam Fatherland Front , Chairman of the Central Inspection Committee, Chief Justice of the Supreme People's Court, Director of the Supreme People's Procuracy and Secretaries of Hanoi City Party Committee and Ho Chi Minh City Party Committee, equivalent titles and titles with starting pay rate of 10.4 or more, are allowed to regularly use a car during their working time.

Based on the actual situation at the time of car equipment, the Prime Minister shall decide on the types and purchase prices of cars for these titles at the proposal of the Minister of Finance on the basis of proposals of ministers, heads of central agencies and relevant provincial-level People's Committee chairmen.

The titles which are allowed to use a car with a maximum purchase price of VND 1,100 million per car during the working period are:

1. The Head of the Party Central Committee, Member of the Party Central Committee, Member of the Standing Committee of the National Assembly, Chairman of the Ethnic Council of the National Assembly, Chairman of the Committees of the National Assembly, State Auditor General, ministers, heads of ministerial-level agencies, vice-chairman and general secretary of the Central Committee of the Vietnam Fatherland Front, heads of central organizations, equivalent titles and titles with starting pay rate of 9.7 or more.

2- Secretaries of the Provincial and municipal Party Committees of provinces and cities under the Central government except Hanoi city and the Ho Chi Minh City.

3- The following titles of Hanoi City and the Ho Chi Minh City: Deputy Secretary of the City Party Committee, Chairman of the People's Council, Chairman of the People's Committee, Head of the National Assembly delegation in charge.

Titles which are use cars from place of residence to offices and for business trips with a maximum buying price of 920 VND million/car, include:

- Deputy Head of the Party Central Committee, Vice Chairman of the Ethnic Council of the National Assembly, Vice Chairman of the National Assembly Committee, Deputy Chief Justice of the Supreme People's Court, Deputy Head of the Supreme People's Procuracy, Deputy State Auditor General; Heads of Governmental agencies, Vice Ministers, Vice Chairman of the Central Committee of the Vietnam Fatherland Front, Deputy Heads of Central Organizations, Permanent Secretary of the Central Committee of the Ho Chi Minh Communist Youth Union, Directors General and leadership titles with allowance coefficient of 1.25 or more. - Deputy Secretary of Provincial and municipal Party Committee, Chairman of People's Council, Chairman of People's Committee, Head of National Assembly delegation in charge of provinces and cities under central government, except Hanoi city and the Ho Chi Minh City.

- The following titles of Hanoi City and the Ho Chi Minh City: Member of the Standing Committee of the city Party Committee, Vice Chairman of the People's Council, Vice Chairman of the People's Committee, Deputy Head of the National Assembly delegation in charge, Chairman of the Fatherland Front Committee.

- Chairman of the Members' Council, Directors General of groups and corporations established by the Prime Minister’s decisions (Economic Group).

In a case where the above mentioned titles voluntarily accept the expenditure allocation for the use of cars, the ministers, the heads of the central agencies, the Standing Committee of the provincial and municipal Party Committee, the provincial People's Committee and the Council members of the Economic Groups shall base on the actual situation of the agencies, organizations, units, economic groups, the allocation method and numbers of titles accepting the expenditure allocation for consideration and decision of the expenditure and number of cars to be equipped, ensuring the thrift and effectiveness between arrangement of cars for working and allocated expenditures for the use of cars. The expenditure allocation is stipulated in provisions of Article 22 of this Decree.

In the case where the above titles of each ministry, each central agency, general department, provincial and municipal party committee, provincial people’s council and committee and economic groups accept allocated expenditures for using cars for the entire process, there is no need to equip cars for titles. The Decree also stipulates cars for general work, which prescribes titles entitled to standards for the use of cars for general work for business trips; cars serving the general work of the Department, Agencies and equivalent organizations under the Ministry and central agencies; cars for general service of the Department, Agency, Board and equivalent organizations attached to and under the General Department and equivalent organizations (General Department); cars serving the general work of the Department, departmental - level organizations under the General Department with a vertical apparatus in the provinces and cities under the central government; cars for the general work of agencies, organizations and units of the provincial level; cars for general work of district-level agencies; cars for the general work of state owned enterprises and cars for the general work of the project management board.

Rearrangement and handling of cars

Regarding the rearrangement and handling of cars for titles, cars for general work, the Government requests ministries, central agencies, provincial people’s committee to base on the standards and norms for the use of cars described in this Decree to review and rearrange the number of existing cars of agencies, organizations and units managed by the ministries, central and local agencies; and to handle redundant cars in accordance with the provisions of Law on use and management of public assets and documents detailing the law implementation. This must be completed before 31 December 2019.

The organizations, agencies and units are responsible for fully updating the data of cars after review and handling to the National Database on public assets within described time.

State owned enterprise bases on the standards and norms stipulated in this Decree to review and rearrange the number of existing cars; to handle redundant cars according to the law on the management and use of state capital investing in production and business at enterprises and relevant laws. This must be finished before 31 December 2019

Regarding the rearrangement and handling of specialized cars, basing on the standards and norms for the use of public cars, approved and issued by competent persons and authorities, the ministries, central agencies and provincial People’s Committee carry out the review and rearrangement of existing specialized cars of state organizations, agencies, units and enterprises under the management of the ministries, central and local agencies.

In the case where the existing cars satisfy the issued standards and norms, they shall continue to be managed and used. These cars shall be subject to the issued standards and norms for the use of specialized cars.

In the case where the existing cars do not satisfy the issued standards and norms, they will be handled according to provisions of Law on management and use of public assets and documents detailing the law implementation. The handling of these cars must be completed within 6 months since the standards and norms are issued While the standards and norms for the use of specialized cars have not been issued, the organizations, agencies and units have managed and used specialized cars equipped in line with the standards and norms issued by the competent persons and authorities before 1 January 2018, the allocation, new purchase and transfer of cars shall be not carried out. After the standards and norms for the use of specialized cars are issued, the ministries, central agencies and provincial people’s committee implement the arrangement and handling according to the above provisions.

The Decree shall take effect from 25 February 2019.
