Ha Tinh Customs has not yet collected VND 29 billion of irrecoverable tax debts

 VCN- Ha Tinh Customs Department has actively taken measure to urge and enforce the collection of outstanding tax debts, but so far the amount of tax debt that is monitored, managed and handled by the Department is still over VND 29 billion. The Department has faced difficulties in completely handle this tax debt amount due to many reasons.

Over the past years, Ha Tinh Customs Department has not yet collected irrecoverable tax debts of businesses which dissolved, vacated and disappeared from the business registration addresses. In order to handle these tax debts, the Customs in general and Customs officers directly collecting tax debts in particular face many difficulties.

Currently, the tax debt amount in Ha Tinh Customs Department has decreased by VND 18.5 million, of which, over VND 11.8 million of late tax payment of Xuan Hoa Joint Stock Company was written-off; and reduced 6.7 million of tax debts for Dai Thien Thanh Co., Ltd due to their liquidity and implementation of decision on non tax collection under the instruction of the General Department of Vietnam Customs. Currently, the Department has completed 6 dossiers and submitted to the General Department of Vietnam Customs for consideration to write-off tax debts for eligible businesses. However, as of November 30 2018, Ha Tinh Customs Department managed, monitored and handled over VND 29 billion of tax debts of 28 businesses. These are tax debts and fines for late payment of Customs declaration arising before the effective date of the law on Tax administration 2007.

Most of all tax debts arose before 2000, these debts are irrecoverable because these businesses dissolved, vacated and disappeared from the business registration addresses or the owners died. Notably, among 28 businesses delaying tax debts, there are many businesses having huge tax debts such as Bac Son One Member Liability Company Limited having fines for late payment of over VND 8 billion before 2007, currently, the owner of this company died. Besides, the company has debts of nearly VND 100 billion at Ha Giang Customs Department.

According to a representative of Ha Tinh Customs Department, the debts managed by the Department are irrecoverable debts because they were 10-year tax debts or businesses were dissolved, vacated and disappeared from the business registration addresses, stopped or suspended their operation. Thereby, when making dossiers for debt write-off, the Department has faced difficulties in collecting information to prove that businesses have not complied with coercive measures as per regulations.

Talking with the Vietnam Customs Newspaper’s reporter, Mr. Dao Chi Thanh, the Head of Operational Division of Ha Tinh Customs Department said that “on 18th May 2018, the General Department of Vietnam Customs issued Decision 1503/QD-TCHQ regulating the tax management and other revenues for import and export goods. According to this decision, the irrecoverable tax debts have been gradually written-off. Currently, instead of directly arriving at businesses’ offices for tax debt collection, Ha Tinh Customs department has focused on handling dossiers for debt write-off”.

Besides the information collection of businesses, the completion of dossiers on write-off debts is also hard. For the coercive measures for the recovery of business registration certificates, establishment and operation license, practising certificate …, in many cases, the Department has sent an official letter to sectors, departments and localities but it has not received the feedback and coordination from them.

Although facing difficulties in collecting tax debts, with the great efforts in 2018, the General Department of Vietnam Customs wrote-off tax debt for Xuan Ha Joint Stock Company (in Nghi Xuan-Ha Tinh) and Dai Thien Thanh Co., Ltd (in Ho Chi Minh City) with a total amount of VND 24.04 million. Currently, Ha Tinh Customs Department has proposed to the General Department of Vietnam Customs to write- off tax debts for 5 businesses.
