General Department of Vietnam Customs directs strengthening inspections of sanitary equipment

Accordingly, during the processing of customs procedures for import and export goods, the provincial and municipal Customs Departments shall direct their customs branches to strictly comply with the Government's Decree No. 08/2015/ND-CP (amended and supplemented in Decree 59/2018 / ND-CP); the Government's Decree No.31/2018/ ND-CP on goods origin; Circular 38/2018/TT-BTC of the Ministry of Finance regulating the determination of the origin of export and import goods; inspection process for goods determination of the General Department of Vietnam Customs; Official Letter 5189/ TCHQ-GSQL. The goods labeling shall comply with the provisions of the Government’s Decree 43/2017/ND-CP; relevant guiding documents of the Ministry of Finance and the General Department of Vietnam Customs.
For consignments subject to dossier examination and physical inspection, the General Department of Vietnam Customs has requested Customs officers to check names, quality, origin, labels of goods on the declaration with the documents in customs dossier (C/O andInvoice). If the name and origin of import and export goods on customs declarant are inconsistent with those in the documents in the customs dossier and in C/O and information shown on goods’ labels is inappropriate, it will be handled according to regulations.
For exported goods, if there is a suspicion that customs declarants have declared goods origin incorrectly or show signs of taking advantage of Vietnamese origin and labels to illegal transshipment and avoid trade remedies, provincial and municipal customs departments shall verify at authorities that issue C/O or inspect production establishments to determine the origin and production place of goods according to regulations. In case of necessity, summarize report and send the dossier to the General Department of Customs for guidance on handling.
The General Department of Vietnam Customs instructs provincial and municipal customs departments to check the declared value on the import customs declaration with documents in the customs dossier to determine the declared value in accordance with regulations. If suspecting the declared value, the ruling, inspection and determination of values shall be implemented in accordance with regulations.
The units strengthened the patrol, control and supervision of goods at the border. During supervising goods at the border gates, if detecting goods without labels, origin or suspicion on the quantity, category, quality and origin of goods, the physical inspection shall be conducted at the border gate and information transferredto the Customs Branch where the declaration is registered for handling.
If enterprises violate the law, evade tax or import goods suspected of value, labels or quantity, they need to set up criteria to list these subjects to high risk for applying appropriate inspection and supervision measures and conducting post-clearance audit to assess the level of compliance with the law of enterprises.
