Accordingly, HCM City Customs Department instructed the firm on the import policy of tobacco pipes based on Article 4, Decree 69/2018/NĐ-CP of the Government on import and export procedures stipulating that: for goods imported and exported by license, import-export trader must have a license granted by related ministers and ministerial-level agencies.
For goods imported and exported under condition, the import-export trader must meet conditions as in the regulations.
Regarding goods on the list of exported and imported goods subject to inspection as prescribed in Article 65 of the Law on Foreign Trade Management, traders are subjected to inspection by competent authorities in accordance with regulations.
For goods that are not specified in Clauses 1, 2 and 3 of this article, the trader only has to implement import and export procedures at the customs authority. The list of goods imported and exported under licenses and conditions is specified in Appendix III to Decree 69/2018/ND-CP.
Pursuant to Article 4 of Decree 69/2018/ND-CP of the Government on goods banned from import and export, stipulating that: “Pursuant to Appendix I of this Decree, ministries and ministerial-level agencies should announce the detail of goods banned from export or import, together with HS codes, based on the exchange and agreement with the Ministry of Industry and Trade on the list of goods and agreement with the Ministry of Finance on HS codes.”
In particular, the HCM City Customs Department told enterprises that, the case of “tobacco pipe" that is used are subject to prohibition from import in accordance with Appendix I issued together with Circular 12/2018/TT-BCT.
Regarding the state management of tobacco products, HCM City Customs Department requested businesses to collate the provisions of the Law on Tobacco Harm Prevention, Decree 67/2013 / ND-CP (amended and supplemented in Decree Decree 106/2017 / ND-CP) as reference for implementation.
