Accordingly, the Ministry of Finance stated: Through the management, inspections and supervision of the prevention and fight against smuggling and trade fraud for the import of automobiles of Au Chau Automotive Joint Stock Company (tax identification number: 0304791427, address number: 808 Nguyen Van Linh street, Tan Phu ward, District 7, HCM City), Customs officers found 3 major violations.
The first was that this company deliberately imported BMW cars without the approval of Customs authorities during the time waiting for Customs clearance under current regulations.
The company did not provide certificates of origin (C/O), records, papers and documents of imported BMW cars, and there were signs of fraud to purposely deceive customers.
The company falsified documents such as sale contracts and commercial invoices to import BMW cars.
According to the Customs Law, the Law on Tax Administration and relevant Laws, and in order to ensure a healthy business environment under Government Resolution 35/ND-CP on support and development of businesses to 2020, against smuggling, commercial fraud, tax evasion, as well as ensuring the legal rights of consumers, the Ministry of Finance has requested the General Department of Vietnam Customs to suspend Customs clearance of shipments with imported BMW cars (except for diplomatic cases).

In addition, the Ministry of Finance has requested the General Department of Vietnam Customs to collaborate with the Supreme People's Procuracy to prosecute the violations of Au Chau Automotive Joint Stock Company.
