Suggesting new charges for certificate of origin

The Ministry of Finance is drafting Circular prescribing fees and charges payable in the certificate of origin (C/O), collection, transfer, management and use thereof |
According to the Draft, the payer is a trader who has applied for a certificate of origin as specified in Clause 17, Article 3 of Decree No. 31/2018/ND-CP of the Government prescribing the Law on foreign trade on the origin of goods.
Fee-collecting organizations include the Ministry of Industry and Trade and agencies and organizations authorized by the Ministry of Industry and Trade to issue C/O in accordance with the provisions of Article 34 of the Law on Foreign Trade Management.
The fee for issuing C/O is regulated as follows: fee for new issuance of VND 60,000/set of C/O; fee for re-issuance and additional issuance: VND 30,000/set of C/O.
The Ministry of Industry and Trade is entitled to leave 83% of the total fees collected to cover the costs of providing services, collecting fees and paying expenses for agencies and organizations authorized by the Ministry of Industry and Trade to issue C/O, collect fees in accordance with the provisions of law; paying 17% of the total fee collected into the state budget (central budget).
In the case, the Ministry of Industry and Trade is a state agency that is not eligible to allocate operating expenses from the fee collection as prescribed in Clause 1, Article 4 of Decree No. 120/2016/ND-CP, 100% of the collected fee must be paid into the state budget.
The source of expenses for service provision and fee collection is guaranteed by the state budget. The Ministry of Industry and Trade estimates funding for service provision and fee collection (including authorized funding) following the regime and norms of state budget expenditure as prescribed by law.
