Some HS codes converted to comply with the list of import and export goods 2022

Intops Vietnam Co., Ltd. Proposed the Customs to guide problems related to the determination of HS codes. In order for the company to have a basis to declare properly according to regulations, o the General Department of Customs said Article 24 of Decree 08/2015/ND-CP; Clause 11 Article 1 of Decree 59/2018/ND-CP amending and supplementing a number of articles of Decree 08/2015/ND-CP; Article 7 of Circular 38/2015/TT-BTC; and Clause 3, Article 1 of Circular 39/2018/TT-BTC amending and supplementing a number of articles in Circular 38/2015/TT-BTC of the Ministry of Finance clearly stipulate the declaration of customs documents and commodity codes.

Circular 65/2017/TT-BTC promulgating the List of import-export goods of Vietnam; Circular 09/2019/TT-BTC amending and supplementing a number of contents in the appendices of Circular 65/2017/TT-BTC; and Circular 31/2022/TT-BTC of the Ministry of Finance promulgating the List of Import-Export goods of Vietnam also stipulate commodity codes.

Accordingly, goods belonging to HS codes 8517.70.10, 8517.70.21 and 8517.70.29 on the List of import and export goods of Vietnam issued together with Circular 65/2017/TT-BTC have been converted to corresponding HS codes at List of import-export goods of Vietnam issued together with Circular 31/2022/TT-BTC.

Specifically, HS code 8517.70.10 on the List of Vietnam's import-export goods issued together with Circular 65/2017/TT-BTC has been converted to HS code 8517.79.10 in the List of Vietnam's import-export goods issued together with Circular 31/2022/TT-BTC.

HS code 8517.70.21 on the List of import-export goods of Vietnam issued together with Circular 65/2017/TT-BTC has been converted to HS code 8517.79.21 (except for goods as mobile phone components with the nature of flat screen modules, whether or not incorporating a touch screen) and heading 8524 (for goods as mobile phone components of the nature of a flat screen module, whether or not incorporating a touch screen) in the List of import-export goods of Vietnam issued together with Circular 31/2022/TT-BTC.

HS code 8517.70.29 in the List of Vietnam's import-export goods issued together with Circular 65/2017/TT-BTC has been converted to HS code 8517.79.29 in the List of Vietnam's import-export goods issued together with Circular 31 2022/TT-BTC.

The General Department of Customs suggested that enterprises base on instructions and study documents and actual imported goods to determine the appropriate code.

The General Department of Customs said that if enterprises need to determine codes for goods expected to be imported and exported, they can carry out procedures for pre-determining codes as prescribed in Decree 08/2015/ND-CP, Decree 59/2018/ND-CP, Circular 38/2015/TT-BTC and Circular 39/2018/TT-BTC, or contact the customs branch where the declaration is expected to be opened for detailed guidance.
