Rush to finalize draft decree on public asset restructuring

In a petition submitted to the Ministry of Finance ahead of the 15th National Assembly's 7th session, Hoa Binh province's constituents requested specific guidance on the implementation of public asset restructuring and disposal as outlined in Government Decree No. 167/2017/ND-CP.
In response to the constituents' petition, the Ministry of Finance stated that pursuant to the Law on Public Asset Management, it had promulgated Decrees No. 167/2017/ND-CP and No. 67/2021/ND-CP stipulating the restructuring and disposal of public assets.
According to the Ministry, the restructuring and disposal of real estate belonging to ministries, agencies, and localities had achieved significant results over several policy phases. However, the progress of such activities remained slow, with 74,605 out of 256,652 facilities still awaiting approval for restructuring and disposal plans.
To provide further guidance, the Ministry of Finance issued Circulars No. 37/2018/TT-BTC and No. 125/2021/TT-BTC, which detailed the procedures, forms, and approval authorities for restructuring and disposing of real estate, vehicles, machinery, equipment, and other public assets.
The Ministry emphasized that upon the issuance of Decrees No. 167/2017/ND-CP and No. 67/2021/ND-CP, it had organized training sessions for ministries, agencies, and localities, provided written guidance, and offered direct support upon request, including to Hoa Binh province.
Recently, as part of the government's legislative program, the Ministry of Finance, in collaboration with ministries, agencies, localities (including Hoa Binh province), and corporations, has drafted a new decree on public asset restructuring and disposal to replace Decrees No. 167/2017/ND-CP and No. 67/2021/ND-CP.
The draft decree is currently being finalized for submission to the Government.
It’s known that the Ministry has already conducted consultations to gather feedback from various ministries, agencies, and localities.
The Ministry of Finance has comprehensively considered all suggestions, recognizing that each input is based on practical experience and reflects the challenges encountered during the implementation of public asset restructuring and disposal.
