On December 20, 2021, the Ministry of Agriculture and Rural Development issued Circular 16/2021 introducing the list of potentially unsafe products and goods under the authority of the Ministry of Agriculture and Rural Development. This circular came into force from February 3, 2022.
The appendix issued together with the circular stipulates nine groups of items subject to quality inspection, including "Machine and equipment used in the Agriculture and Rural Development industry" (Section 9) including machines and equipment with names and HS codes described in Appendix 26 of Circular 11/2001 dated September 20, 2021 of the Ministry of Agriculture and Rural Development, including the item "tractors for agricultural use” with different capacities.
At the same time, the item "tractors for agricultural use" in heading 8701 in the List of exported and imported goods of Vietnam is also subject to quality inspection according to Circular 41/2018/TT-BGTVT dated January 30, 2018 of the Ministry of Transport.
Thus, the "tractors for agricultural use" belongs to management and post-customs clearance inspection by the two ministries, leading to overlaps in management and difficulties for businesses.

In order to create favorable conditions for businesses and ensure strict management, HCM City Customs Department has reported the problem to the Customs Management and Supervision Department (General Department of Customs) for guidance.
