Localities face difficulties because the Central Government is slow to issue norms

VCN - Most localities have completed the issuance of documents on the implementation of the Law on management and use of public assets under the direction of the Government and the provisions of the Law. However, there are still many issues for Central Government to resolve, especially related to specialized machines and equipment before implementation.

So far, Hanoi has issued a number of documents to implement the Law on management and use of public assets such as: decentralize management of the use of public assets according to the authority; decentralize management and use assets owned by the people; opening a temporary account at the state treasury.

owever, there are still some documents that have not been issued such as standards and norms for the use of specialized public assets and equipment to agencies, organizations and units under the management; standards for specialized working offices and establishments of public agencies; regulations of the provincial People's Committee on high-value assets to determine competence to approve a project on the use of public properties in public non-business units for business and leasing purposes.

The reason for slow publication of these important documents is that some ministries and agencies have not issued guidance documents on norms for the use of specialized public assets, so the localities have difficulties in implementation.

There are some difficulties and problems in the implementation. They are: determination of the adjustment for housing and land facilities invested and built by the welfare fund of enterprises; land, houses and works attached to land that are infrastructure assets serving public interests; the application for joint stock companies with state capital and level 2 and level 3 subsidiaries; the selection of joint venture and associate partners to implement projects in accordance with the law on bidding when being transferred in the form of "land use purpose conversion" ...

After 1 year of implementing the Law, Ho Chi Minh City has issued guidance documents on the management and use of public assets under its jurisdiction, and issued regulations on decentralization of asset management to contribute to strengthen management of public assets closely, quickly, economically, preventing waste and loss and using public assets effectively.

Agencies and units assigned to manage and use public assets must fully comply with legal provisions; have consistency in assignment and decentralization; comply with the authority. Investment, equipment and use of public assets must be in accordance with standards and norms, ensuring savings and efficiency.

The handling and arrangement of land and houses in the area are regularly adjusted and put in order. The People's Committee of HCM City regularly directs and urges relevant units to review and inspect to avoid misuse and waste, handle violations such as withdrawal, transfer and auction and liquidation to increase resources for the City budget to reinvest and repair working facilities and upgrade urban infrastructure.

During the implementation, Ho Chi Minh City has proposed to remove and guide on a number of problems faced. The most important one is to propose to the Ministry of Finance to work with the Ministry of Health and the Ministry of Education and Training to urgently issue detailed guidelines on standards and norms for the use of specialized public assets to the localities as a basis for implementation.

Ho Chi Minh City also proposed to the Ministry of Finance to guide the use and management of public vehicles after arranging redundant vehicles and the estimation to implement the public vehicle policy specified in the guidance documents; clearly define the deadline for joint venture, association and leasing projects; guide the use of a part of brand value to contribute capital to joint ventures and associates, state-owned land.

Da Nang has directed all levels and sectors in the area to wholly implement the Law. However, the implementation of management and use of public assets in Da Nang still has some shortcomings.

Through the implementation, the City still faces some difficulties and problems such as: Decree No. 04/2019/ ND-CP of the Government on standards, norms for the use of cars and The Ministry of Finance subsequently issued Circular No. 24/2019/ TT-BTC guiding the implementation of this Decree.

However, some ministries such as the Ministry of Health, Ministry of Education and Training have not yet issued a circular guiding the standards and norms for the use of specialized public assets to the localities as a basis for implementation. Without a guiding document, it is very difficult for the locality to procure public assets, we have consulted the Ministry of Health three times to remove difficulties. Thus, we proposed that the ministries soon issue a circular, otherwise the localities will have difficulties in implementation.
