“Abolished” the regulation on testing the formaldehyde content

On October 12th, 2016 the Minister of Industry and Trade, Mr. Tran Tuan Anh, signed Circular No.23 deregulating the limits and the testing of the content of formaldehyde and aromatic amines derived from azo colorants in textile products. This Circular will take effect from November 26, 2016.

Previously, the Ministry of Industry and Trade issued Circular No.37/2015/TT-BCT regulating the limits and testing of the content of formaldehyde and aromatic amines derived from azo colorants in textile products in the Vietnam market.

Circular No.37 applies to organizations and individuals producing and importing textile products sold in the Vietnam market; organizations designated and authorized by the Ministry of Industry and Trade to participate in State inspection activities of formaldehyde and aromatic amines content derived from azo colorants in textile products.

Also, according to Circular No.37, the State inspection order and procedure for textile products which are domestically produced and the testing of the content of formaldehyde and aromatic amines derived from azo colorants in textile products which are domestically produced must comply with the provisions of the Law on Products and goods quality; theinspection order and proceduresmust comply with the provisions of Article 20 of Circular No.48/2011/TT-BCT.

The implementation of testing formaldehyde and aromatic amines contentderived from azo colorants in imported textile productsis made ina variety of forms: Common testing, decreasing testing, record testing and probability testing.

However, when Circular No.37 was issued to replace Circular No.32/2009/TT-BCT, the textile enterpriseshave "called for help" many timesbecausethe regulation on testingformaldehyde content in textile products has made it difficult for enterprises and causeda waste of time and money.

Thus, the abolition of this regulation is good news for textile enterprises in the context of the market with many difficulties; the plan to export a value of $US 29 billion in 2016 is also difficult to achieve.
