Accordingly, the Department of Animal Health stated that on 25 December 2018, the Ministry of Agriculture and Rural Development issued Circular No. 35/2018/TT-BNNPTNT and Circular No. 36/2018/TT-BNNPTNT, stipulating that when an imported goods shipment meets the quarantine requirements, the border-gate animal quarantine agency shall grant the Quarantine certificate for imported animal products (form 15b) and Quarantine certificate for imported animals and animal products (form 10TS), which clearly states the use purpose of the imported shipment.

Importers of terrestrial and frozen fishery products meet obstacles in Customs clearance due to the requirement of both Quarantine Certificate and Notification of eligibility for imports.

In order to create favorable conditions for importers, to prevent goods congestion at the border gate, the Department of Animal Health recommended that the General Department of Customs should direct border-gate customs units to carry out customs clearance for the shipments granted import quarantine certificates (form 15b, form 10TS) stipulated in Circular No.35/2018/TT-BNNPTNT and Circular No.36/2018/TT-BNNPTNT.

Regarding difficulties and obstacles when applying Decree No. 15/2018 / ND-CP, the Department of Animal Health said, according to the reflection of border-gate animal quarantine agencies under the Department of Animal Health, is stipulated in Article 18 Decree No. 15/2018/ND-CP on application for inspection and self-announcement of products. However, as stipulated in Article 4 of Decree No. 15/2018/ND-CP, imported products of terrestrial animals and frozen fishery products, which are unprocessed and unpacked, are not subject to self-announcement of products.

With the above provision, the Department of Animal Health required the General Department of Customs to consider and propose the Government for amendment to the contents and removal of difficulties and obstacles.

As informed to the Customs Newspaper, according to fishery enterprises, recently when Circular 36/2018/TT-BNPTNT (amending Circular 26/2016) stipulating the fishery quarantine took effect, importers of some processed and packed fishery products face shortcomings which are, an imported shipment must have 2 Certificates issued by border-gate animal agencies.

The above regulation has made it difficult for importers of terrestrial and frozen fishery products in the customs clearance and raised more administrative procedures and costs, as well as prolonged implementation time for both fishery enterprises and border-gate Veterinary and Customs agencies.
