Process for checking quality of imported scraps

VCN – Ministry of Natural Resource and Environment issued a guidance document to instruct provincial Department of Natural Resource and Environment on the implementation of the Circular 08/2018/TT-BTNMT and Circular 09/2018/TT-BTNMT promulgating the national technical standards on environment for imported scrap as raw materials for production.

According to the provision in the Circular No. 08/2018/TT-BTNMT and Circular No. 09/2018/TT-BTNMT, the authority in charge of state inspection for quality of imported scrap is the Department of Natural Resources and Environment where a factory, production base using imported scrap as raw materials for production is located.

Accordingly, in the guidance document for implementation of Circular 08/2018/TT-BTNMT and Circular 09/2018/TT-BTNMT, the Ministry of Natural Resources and Environment guided the Department of Natural Resources and Environment to inspect the quality of imported scrap which would be implemented in 3 following steps:

Step 1: To receive and check the completeness and validity of registration dossiers for quality inspection of imported scraps.

In this step, the Department of Natural Resources and Environment will receive and check the validity and completeness of the registration dossiers for quality inspection of imported scraps; Paper of State registration of quality of imported scrap materials; Contracts on the purchase and sale of scrap attached with the list of imported scrap (copies); list of scrap imported under the contract; Paper of quality inspection for imported scrap; bill; bill of lading; Declaration of imported scrap; photo or description of imported scrap; Confirmation of eligibility on environmental protection in the import of scrap for use as raw production materials (copies); Confirmation of deposit for imported scrap of the imported scrap shipment registered for state inspection.

The receiving and return of state inspection result of imported scrap quality shall be implemented through the direct receipt of dossiers, post offices or email belonging to the electronic information system of the provincial People's Committees.

In cases where the importers registered for quality inspection on the national single window portal, the authority shall register for inspection and return results of quality inspection through the national single window portal.

Step 2: Organizing the physical inspection, examination and taking sample (for the cases where taking sample is required).

It means that after receiving the announcement by written document of the organization or individual registering for the place of conducting inspection and taking sample, the Department of Natural Resources and Environment will chair and coordinate with the customs authority and appointed inspection organization and the related authorities to organize the inspection and take samples for evaluating the quality of imported scraps of imported shipment in accordance with the regulations.

Step 3: Identify the organizations and individuals that have registered for quality inspection of imported scraps on the registration forms of the importing organizations or individuals and inform the results of state inspection about the quality of imported scraps to organizations and individuals registering for inspection.

Accordingly, the Department of Natural Resources and Environment will inspect the contents, including: Checking the conformity of the content of quality inspection of imported shipment of scrap compared with requirements of technical regulation of national technical regulation on environmental responsibility for imported scrap registered for inspection; To check the accuracy and consistency of information on the registration dossiers for quality inspection of imported scraps; For invoices, bills of lading, it needs to check the quantity, HS codes, import ports whether it matched with the State examination registration documents and import declaration of scraps.

In addition, the Ministry of Natural Resources and Environment requests the provinces Department of Natural Resources and Environment to promptly review and update the status of issuing valid certificates on the National Single Window Portal and Public Service Portal of the Ministry of Natural Resources and Environment. In case the Department of Natural Resources and Environment is not up to date, Customs authorities would not have grounds to implement customs clearance. Thus it would lead to the situation of backlogged scraps at the port and causing damage to the enterprise.

Besides that, the Ministry of Natural Resources and Environment also urged the Department of Natural Resources and Environment to create e-mail under the electronic information system of provincial People's Committees in order to serve for the activities of customs clearance of imported scrap, receiving and returning state inspection on the quality of imported scrap, including information on types, HS codes and volumes of imported scrap.
