Prime Minister request to stop receiving cars as gift from business

VCN - In order to avoid negative phenomena through the form of gifts from enterprises as well as avoid loss of State property in the form of tax exemption for imported vehicles, the Prime Minister requests ministries and branches, the People's Committees of the provinces and cities directly under the Central Government to stop receiving cars as gifts from enterprises.

The above content was stated in Announcement No.127 / TB-VPCP about the conclusion of the Prime Minister on receiving cars as gifts from enterprises.

The announcement stated clearly that, at the Government's regular meeting in February 2017, the Government agreed to immediately terminate to receive donated cars of enterprises of local authorities and State agencies, especially enterprises having business activities in the province.

For the giving and receiving gifts of agencies, organization and units used State budget and civil servants, ministries, branches and local authorities must follow the provisions of Decision No. 64/2007 / QD-TTg dated 10/5/2007 on giving, receiving and returning gifts of State budget-funded agencies, organizations, units and civil servants. In particular, for agencies and organizations that suggested to be donated, they must follow the current law provisions to determine the appropriateness of receiving assets; leader of the agency will take full responsibility for the receiving of assets in accordance with the Decree No. 29/2014 / ND-CP dated 10/4/2014 of the Government stipulating the competence and procedures for establishing property ownership of the State, management and disposal of resources.

The procurement of automobiles that served for work is implemented in accordance with Decision No. 32/2015 / QD-TTg dated 4/8/2015 stipulating the criteria, norms and management regime and use of automobiles in State agencies, public service units, limited liability companies with 100% of charter capital owed by the State.

Reviewing cars for liquidation

The Prime Minister assigned to the Ministry of Finance to review the total number of cars in excess in order to transfer to ministries, branches and localities that have demand; To coordinate with the Ministry of Justice and the Government Inspectorate to examine and clarify the receiving and using automobiles from enterprises by ministries, branches and localities; In case of detecting mistakes, define clearly the responsibilities of the concerned organizations and strictly handling according to their competence and the provisions of law. Then reporting to the Prime Minister before 28th April 2017.

In addition, all cars of State agencies should be reviewed to ensure that vehicle liquidation is carried out in accordance with the law, publicly and transparently. The amount of money form car liquidation will be collected and remitted into the State budget, doing carefully to prevent loss of public assets; To review the existing mechanisms and policies on the management and equipping of public assets for supplementation and modification on the principle of ensuring the strict and effective management of public assets; At the same time, overcome the shortcomings of State agencies receiving property (including cars) donated by enterprises as reflected in the mass media time too.

The Prime Minister has assigned the Ministry of Public Security to review immediately the license plate number for vehicles that have been liquidated by State agencies; Report on the management and use of license plates; To coordinate with the Ministry of Finance and the Ministry of Justice in examining and establishing a mechanism on the auction for car number plates. Then reporting to the Prime Minister in May of 2017.

The Prime Minister also assigned to the Ministry of Defense to review and withdraw the number plates granted to enterprises that are not involved in defense missions.
