Expanding enterprises and border gates

Compared to the period of pilot application of specialized mechanism on shifting border gates for imported goods to My Dinh ICD, the new Prime Minister’s Decision expand the entities of enterprises as well as border gates that are permitted to transport goods to implement Customs procedures at My Dinh ICD.

According to the pilot specialized mechanism, only goods imported via Hai Phong Port and of enterprises that have headquarters or branches, representative offices in Ha Noi are permitted to shift border gates to My Dinh ICD.

However, Decision 38/2017/QD-TTg stipulates that the expanded entities of enterprises are organizations and individuals who implement the import, export and transit of goods.

Goods imported via international land-road border gates, international railway stations, international airports, seaports, which are shifted border gates to My Dinh ICD for implementation of Customs procedure, are goods under the List of imported goods which are required to implement the Customs procedure at entry border gates (issued together with Prime Minister’s Decision 15/2017/QD-TTg dated May 12, 2017), excluding goods which are aircraft, yacht, gasoline of all types, explosive precursors, industrial explosive materials under the List regulated by the Ministry of Industry and Trade and scraps under the List regulated by the Prime Minister.

The maximum transport time must not exceed 48 hours

Decision 38/2017/QD-TTg also stipulates transport route and time which are declared by declarants and approved by Customs authority where goods are transported out. The maximum transport time must not exceed 48 hours from the time when goods are transported across Customs supervision area at the border gate.

The time for store of goods to complete Customs procedures at My Dinh ICD is maximum 30 days from the date when goods are transported to My Dinh ICD except for goods which must wait for results of specialized inspections or are being handled by competent authorities.

Goods shifted border gate to My Dinh ICD are not permitted to shift to other places for implementation of Customs procedures.

Transporters have responsibility for arranging means of transport which meets the supervision requirement of Customs. The means of transport must be equipped tracking devices GPS and connected with Customs authority where goods transported in and out to monitor transport processes.

At the same time, informing Customs Branch which manages My Dinh ICD, Ha Noi city right after goods are loaded onto means of transport to transport across supervision area at entry border gate for goods in border gate shifting which are implemented physical inspections, transported to stores or specialized inspection points.

Goods must be transported on the right routes and time registered and approved by Customs authority.

In case of force majeure, the status quo of goods, Customs seals are not ensured or goods are not transported on the right routes and time as per regulations, after applying of necessary measures to limit and prevent losses, the transporters must report to Customs authority where goods are transported in and out to handle. If they cannot inform immediately Customs authority, they will depend on the area to inform with Public Security Authority, Border Guard or Coast Police to confirm and solve.

Port operators at My Dinh ICD have responsibility for ensuring inspection and supervision conditions of Customs authority. Only shipments which are cleared, released or transported to stores or specialized inspection points by Customs authority as per provisions of the law, are permitted to transport out My Dinh ICD. At the same time, connecting goods management information system of enterprises with Customs authority to manage goods transported in and out or stored in My Dinh ICD.

The Customs procedures for goods in border gate shifting to My Dinh ICD are implemented under provisions of Customs Law and Government’s Decree 08/2015/ND-CP.

According to statistics from Ha Noi Customs Department, from the beginning of the year to the end of July 2017, Tax revenues from the implementation of specialized mechanism of border gate shifting for import consumable goods at My Dinh ICD reached 428.89 billion VND. The Ha Noi Customs Department processed 1,122 declarations under this mechanism, an increase of 42.9% compared to the same period in 2016.
