Issue Decree 59 and Circular 39

The General Department of Vietnam Customs has submitted to the Ministry of Finance a report to the Government and the Prime Minister for signing 3 decrees, including: Decree No. 12/2018 / ND-CP dated 23 January 2018 on the geographical areas of Customs operations and the responsibility to coordinate in the prevention and combat of smuggling and illegal cross-border goods transportation; Decree No. 59/2018 / ND-CP dated 20 April 2018 amending and supplementing a number of articles of Decree No. 08/2015 / ND-CP dated 21 January 2015; Decree No. 84/2018 / ND-CP dated 28 May 2015 which temporarily removes a number of contents specified in the Government's Decree No. 58/2017 / ND-CP dated 10 May 2017. This Decree specifies a number of articles of the Maritime Code of Vietnam on the management of maritime activities.

In addition, 2 Decisions issued by the General Department of Vietnam Customs include: Decision No. 10/2018 / QD-TTg dated 1 March 2018 amending Decision 53/2013 / QD-TTg; Decision No. 20/2018 / QD-TTg dated 26 April 2018 of the Prime Minister stipulating the implementation of confiscated foreign cigarettes, cigarettes and the sale of illegally imported cigarettes at auction places to ensure quality for export to foreign countries.

The General Department of Vietnam Customs submitted to the Ministry of Finance for promulgation of 4 Circulars, including Circular No. 39/2018 / TT-BTC dated 20 April 2015 amending and supplementing Circular No. 38/2015 / TT-BTC; Circular No. 38/2018 / TT-BTC dated 20 April 2018 on the determination of origin of export and import goods; Circular No. 50/2018 / TT-BTC dated 23 May 2018 on criteria, information and forms of declaration when carrying out exit, entry and transit procedures for vessels and inland waterway ports according to the provisions of the Government's Decree No. 59/2018 / ND-CP dated 20 April 2018, and the Ministry of Finance's Circular No. 728/2018 / TT-BTC dated 15 June 2018 regulating the implementation of professional methods of Customs control.

Particularly, the Decree No. 59/2018 / ND-CP and Circular No. 39/2018 / TT-BTC issued a number of new regulations to facilitate the import and export activities of enterprises.

Specifically, there are new regulations promoting the application of information technology in Customs operations, transactions and exchanges of information between Customs offices and customs declarants such as: submission of Customs dossiers, tax refund dossiers, subtraction of permits, sending of samples of goods for preservation, request for cancellation of declarations,

the method of declaration, time of settlement of administrative procedures so as to ensure consistency in the implementation of e-customs procedures.

There are regulations on the management and supervision of goods at ports and airports and the areas of warehouses and yards located in the area of Customs operation.

Specify supplementation of cases which must be sealed and not sealed by Customs.

Broaden the scope of services of transshipment, transit, temporary import for re-export and temporary export for re-import.

Apart from the reform of administrative procedures, the application of information technology (IT) in the above mentioned Customs procedures is to improve the management capacity and timely prevent the abuse of the Laws for smuggling, trade fraud. In addition, provide some measures to strengthen Customs management, such as: Permits to make amendments and / or supplements before the Customs offices notify the results of the Customs declaration. Customs declarations may be canceled only when there are no exported or imported goods; declare the goods management number when carrying out the export procedures or separate the bill of lading for cases where multiple customs declarations are declared for a bill of lading.

The amendment and supplementation have ensured the Government's reform of administrative procedures under Resolution No. 19-2017 / NQ-CP; to enhance risk management in the professional operations of Customs; to ensure clear, specific and transparent regulations and uniform implementation of Customs procedures for imported and exported goods, transport means on exit, entry or in transit; to consolidate the legal framework on Customs information, Customs valuation to ensure Customs management, strengthen anti-smuggling and anti-illegal transportation activities across the borders.

In the last 6 months of 2018, the number of legal documents will be improved by the General Department of Vietnam Customs such as the Government's Decree on the implementation of the National Single Window, the ASEAN Single Window; Decree amending and supplementing a number of articles of Decree No. 68/2016 / ND-CP on conditions for duty-free goods trading, warehouses, yards, Customs clearance sites, the Decree on the implementation of ASEAN-ACTS Customs transit system; Decree on the temporary management under the Istanbul Convention.

At the same time, the General Department of Vietnam Customs also finalized the draft Decision replacing Decision 15/2017 / QD-TTg on promulgating the list of goods subject to Customs procedures at import border gates; Decision to replace the Prime Minister's Decision No. 74/2014 / QD-TTg dated 2 December 2014 on the implementation of regulations on Customs supervision under the Agreement on road transport between the Government of Vietnam and China.
