Talking to Customs Newspaper, Vy Cong Tuong-Deputy Director of Lang Son Customs Department said when carrying out customs procedures for means of carrying import-export goods per criteria 1.31, section 2, Appendix II issued together with Circular 38/2015/TT-BTC amended and supplemented in Circular 39/2018/TT-BTC for land transportation, the number of trucks must be declared, so the department faces some problems.

Specifically, means of carrying Chinese export goods across the border gate (Barie Gate B1) to enter Vietnam to transship and deliver goods in Vietnam’s yards and means of carrying Vietnam’s export goods across the border gate (Barie Gate B1) to enter China to transship and deliver goods via Chinese yards.

Vietnam’s means of transport across the border gate (Barie Gate B1) enter China to bring goods into Vietnam for import procedures.

Or the case of Vietnam’s means of carrying goods to the border gate (not across the border) and then transship to China’s vehicles that are rudimentary cars and small trucks across the border gates many times within the same day for export.

According to Tuong, the declaration of vehicles is prescribed in “4) in case of land transportation: fill the truck number” as per criteria 1.31, section 2, Appendix II issued together with Circular 38/2015/TT-BTC amended and supplemented in Circular 39/2018/TT-BTC, does not specify which truck is subject to declaration of number.

Tuong said currently, border gate customs branches in the province have not performed synchronously in declarations, causing amendments and supplements in customs declaration forms before and after customs clearance, prolonging customs clearance time for consignments and causing difficulties for enterprises and increasing the workload for customs.

Lang Son Customs Department proposed that for imported goods, customs declarants will declare the number of trucks carrying imported goods across (Barie Gate B1) (adjacent to China). For exported goods, customs declarants will declare the number of Vietnam’s trucks carrying goods to the exit border gate for export.

According to the General Department of Vietnam Customs, based on actual activities of transporting import and export goods at the border gate adjacent to China in Lang Son province, the means of carrying exported goods as Vietnam’s trucks to the border gate area for customs clearance must be registered with the Customs agency.

The General Department of Vietnam Customs agreed with the proposal of Lang Son Customs Department. Accordingly, for imported goods, the number of trucks carrying goods across the border gate must be declared on import declaration forms. For exported goods, the number of Vietnam’s trucks carrying goods across the border gate or to the border gate area, yards and sites at border gates approved by the General Department of Vietnam Customs for delivery must be declared.

Kim Oanh of a company specialising in importing consumer goods from China through Huu Nghi international border gate said the declaration of the number of China’s trucks on the import declarations will create favourable conditions for quick customs clearance of goods and cut time and cost for enterprises. In particular, Customs operation will be closely controlled and procedures will be reduced. Oanh said the declaration of the China’s vehicles number on the import declaration is feasible, because if declaring the Vietnamese vehicle number on import declaration will lose efficiency of e-declaration.

Nguyen Cong Tuan, Deputy Manager of Huu Nghi Border Gate Customs Branch (Lang Son Customs Department) said the branch has told customs declarants and enterprises to declare the number of Vietnamese vehicles on the import and export declaration forms. However, this has increased customs procedures for Customs. The General Department of Vietnam Customs has permitted enterprises to declare the number of Chinese vehicles on the import declaration forms that has facilitated and cut costs for enterprises and the customs.

Following directions of the General Department of Vietnam Customs and Lang Son Customs Department, the branch instructed enterprises to declare the Chinese vehicle number on import declaration forms from March 13. If Chinese vehicles have trailers, the customs declarant must also declare the number of trailers on the declaration, Tuan said.
