The anti-loss solution of Customs has been effective

In addition to factors affecting some imported goods such as automobiles and crude oil, it is impossible not to mention the subjective cause as the efforts of the Customs industry in implementing solutions against loss of revenue.

Effective tax management

Determining debt recovery is one of the important solutions in State budget collectionand from the first days of the year, the General Department of Customs directed units to drastically implement many solutions in collecting claiming outstanding debts, at the same time focusing on reviewing and grasping the situation of tax debts of the provincial and municipal customs departments; classifying debt groups that are capable of collecting, irrecoverable debts.Each debt group has a detailed assessment of each item, according to each declaration and each enterprise. Thanks to that, the first quarter the whole industry reduced 52.2 billion VND of tax debt.

In addition, the General Department of Customs issued Decision No. 812/ QD-TCHQ on assigning debt collection targets to provincial and city reform departments.

At the same time, preventing loss through re-identifying codes, value of goods and C/O has been boosted by the General Department of Customs. The General Department of Customs has strengthened the inspection of customs value for export goods, with a focus on checking the value of high-value export commodities such as mineral resources (stone, block stone, metal ores); household electrical appliances branded BOSCH, made in Europe and focused on the inspection of alcohol, cosmetics, sanitary equipment, monosodium glutamate and sugar.

The General Department of Customs has also reviewed the selection of products with high turnover, the tax rate of 15% or more and is collecting information to build and modify the reference price. The result has been collected into the State budget of 75 billion VND from the valuation work.

The General Department of Customs has issued Decision No. 583/ QD-TCHQ on the List of export and import goods at risk of classifying and applying tax rates, thus limiting risks in classification and application of tax. For specialised inspection, data and detailed information have been prepared for the List of specialised inspection goods before customs clearance and post-clearance, management policies for exported goods import to work with ministries and branches. Along with that, we continue to develop draft documents guiding the inspection and identification of origin to prevent frauds of origin and against illegal transshipment.

Use the anti-loss tools

The Customs sector has drastically implemented anti-State revenue prevention tools, notably the inspection, anti-smuggling, trade fraud, economic and legal work and risk management.

From the beginning of the year, along with continuing to promote the economic and social affairs, the General Department of Customs has focused on managing, guiding, inspecting and directing the economic and social activities of the whole force. Besides, the sector is continuing to implementing the task of managing, monitoring and evaluating key enterprises. The implementation of post-clearance investigation for a number of companies: Duty Free Company JaluxTaseco, Thanh Son Mining Joint Stock Company. Deployment of economic and technical topics on goods origin, bonded warehouse, imported raw cashew of FDI enterprises, galvanised steel sheet products, imported corrugated iron sheets, duty-free shops and automobile parts.

In the first quarter, the whole industry implemented the National Economic Relations 284, including 125 at the customs declarant's office (9% compared to the target of 2019, up 16% compared to the same period in 2018), 159 at the customs office headquarters. The total amount of tax assessment and administrative penalty is 397.7 billion VND, actually collected into the State budget (including from 2018) to 366.4 billion VND, up 6% over the same period in 2018.

Particularly in anti-smuggling work, from the beginning of 2019, the Anti-Smuggling Investigation Department strengthened control, anti-smuggling, trade fraud, price, tax rate and risk management, discovering loopholes and shortcomings in State management, policies and laws to propose amendments and supplements to improve the effectiveness of fighting smuggling, trade frauds and fake goods. From December 16, 2018 to March 15, 2019, the whole Customs industry detected, arrested and handled a total of 3,977 violations, the value of infringing goods was estimated at 320,759 million VND, budget revenue exceeded 38,036 million VND; the number of prosecution cases hit 3,989.

Also in the first quarter of 2019, the Inspection Department strictly implemented internal inspection and examination. As a result, from January 1, 2019 to March 15, 2019, the whole sector conducted 37 inspections and inspections (22 specialised inspections and 15 internal inspections) requiring collection and penalise with the amount of nearly 12.5 billion VND. Of which, the tax arrears: 10.1 billion VND; sanctioning administrative violations: 2.3 billion VND, urging the State budget collection of 10.8 billion VND.

The risk management tool wasalso effectively used by the Customs. In the first quarter of 2019, the whole branch divided the customs inspection for 2,347,496 declarations, specifically: Green Channel: 1,353.591 declarations (57.66%) Yellow Channel : 880,142 declarations (37.49%), Red Channel: 113,763 declarations (4.85%).

At the same time, focusing on completing policies and mechanisms such as: Issuing the Decision on the plan of collecting and processing risk management information of the Customs sector in 2019 (Decision No. 237/ QD-TCHQ dated January 31, 2019); The Circular specifies criteria for compliance assessment and organisation of assessing and complying with the law of enterprises in managing import and export activities, goods transit; Conducting the exchange and processing of online monitoring information with units inside and outside the industry, implementing the Regulation on information exchange and coordination with the tax authorities.
