Standard and quota of using car at armed forces

VCN – The Government has issued Decree 85/2018/NĐ-CP stipulating the standard, quota of using cars at armed forces.

Accordingly, the standard and quota for the use of cars by leaders in the Military and the Police force which are members of the Politburo, the Secretary of the Central Committee of the Party, members of the Central Committee of the Communist Party, the Minister, the Vice Minister, the Director General and equivalent titles shall be implemented in accordance with the Decree of the Government regulating the standards and norms for the use of cars.

The decree stipulates the standard and quota for the use of cars by the level of job title. Specifically, the officer with the highest rank is the General who regularly uses one car to perform tasks, based on the actual situation at the time for the preparation of a vehicle. The Prime Minister shall decide on types and prices of vehicles at the proposal of the Minister of Defense and the Minister of Public Security.

Officers with the highest military rank of Lieutenant General and Navy Admiral, shall use a regular car during working times with a maximum purchase price of 1.1 billion VND/car.

Officers with the highest rank of Lieutenant-Commander-in-Chief of the Navy shall use a regular car during working times with a maximum purchase price of 920 million VND/car.

Officers of military rank of Major General and Navy Rear Admiral shall use a car for pick up from his place of residence to the workplace, or for working a mission, with a maximum purchase price of 820 million VND/car.

The standard and quota for the use of cars by the titles in state enterprises under the Ministry of Defense and the Ministry of Public Security shall comply with the Government's decree prescribing standards and norms for using cars.

In the case of people holding many managerial titles, they have the standard of using cars according to the standard of military rank mentioned above, and shall be applied the highest standards. When a predecessor has retired, moved, or has relinquished job titles, but the car which is equipped for serving missions does not meet the replacement conditions as prescribed, the replacement person shall continue using and refitting until the conditions are met for replacing cars in accordance with regulations.

The Decree also specifies standards and norms for use of automobiles for general work.

Specifically, leaders and commanders who have a pay rate of 0.7 or more, or officials with a pay rate of 7.3 or higher at the units of the people's armed forces, who are not entitled to sole use of cars under their title, they are allowed to use a car for general work trips.

In addition, the Decree also contains specific provisions on: standards and norms of use of specialized cars; automobiles for general work of the project management board; price of car; replacing cars at the people's armed forces units; rearranging, handling cars.

The decree takes effect from 15/7/2018. This Decree is issued to guide the implementation of the Law on Management and Use of Public Assets, which was passed by the National Assembly in July 2017.
