Prosecute and implement temporary detention for perpetrators illegally transporting currency across border gates and importing scrap

Talking with the Customs Newspaper reporter on 29 August 2018, the Anti- Smuggling and Investigation Department (under the General Department of Vietnam Customs (GDVC)) said that over the past time, the GDVC has coordinated with the Investigating Police Agency of the Ministry of Public Security (C03) to review, detect and investigate units and individuals having violations in importing scrap into Vietnam.
Based on the investigation results, the Customs authority has determined that Truong Thinh Packing Production Private Enterprise, located at Khanh Hai Commune, Yen Khanh District, Ninh Binh Province led by Nguyen Van Son who is the director, and Hong Viet Construction and Trading Service Co. Ltd., located at Ward 4, District 4, Ho Chi Minh City, led by Le Huu Thiem who is the director and Duong Tuan Anh, who is a executive manager, had signs of making counterfeit documents to illegally import scrap into Vietnam.
At the signing ceremony of the Regulation on cooperation between the Anti-Smuggling and Investigation Department and the Department of Public Prosecutions and Supervision over the Investigation of Economic Crimes (Department 3) (under Supreme People's Procuracy) on 10th August 2018 at the GDVC’s headquarters, Mr. Nguyen Van Quang- Director of Department 3 said that from the results of investigation and verification by the Customs authority, recently, Department 3 has taken the initiative in coordinating with the Investigating Police Agency - under the Ministry of Public Security to consider and continue to criminally prosecute some violations related to the scrap imports. |
Basing on the investigation results, on 28th August, the Anti-Smuggling and Investigation Department issued Decision 15/QD-DTCBL on criminal prosecution for “Illegal transportation of goods and currency across border gates at Hong Viet Co. Ltd”; and Decision 16/QD-DTCBL on criminal prosecution for the act of “Illegal transportation of goods and currency across border gates at Truong Thinh Private Enterprise”.
On the same day, Investigating Police Agency of the Ministry of Public Security (C03) issued decisions and warrants, including: Decision No.144/C03-P15 on criminal prosecution and Warrant No. 42/C03-P15 on temporary detention for Nguyen Duc Truong-Director of Duc Dat Co. Ltd.
Decision No.145/C03-P15 on criminal prosecution and Warrant No. 41/C03-P15 on temporary detention for Nguyen Van Son -Director of Truong Thinh Private Enterprise.
Decision No.146/C03-P15 on criminal prosecution and Warrant No. 43/C03-P15 on temporary detention for Duong Van Phuong – a staff member of Truong Thinh Private Enterprise.
Decision No.143/C03-P15 on criminal prosecution and Warrant No.40/C03-P15 on temporary detention for Duong Tuan Anh- Executive management of Hong Viet Co. Ltd., for the act of “Illegal transportation of goods and currency across border gates” under Article 189 of the Criminal Law 2015; and a Warrant for inspecting places of residence and work of these perpetrators.
These decisions and warrants have been approved by the Supreme People's Procuracy.
Currently, the Investigating Police Agency of the Ministry of Public Security (C03) has coordinated with the Anti-Smuggling and Investigation Department to thoroughly investigate perpetrators and relevant objects to strictly handle in accordance with the law.
At the same time, continuously investigating and clarifying responsibility of units and individuals related to the backlog of over 10,000 containers at seaports to strictly handle in accordance with the law.
Regarding the violation in importing scrap, on 17th July 2018, the Anti-Smuggling and Investigation Department (under the GDVC) issued decisions on criminal prosecution for the act of “Illegal transportation of goods across border gates” related to Duc Dat Import-Export Trading Service Co. Ltd., (located in Yen Khanh district, Ninh Binh) which made counterfeit papers and documents to import more than 13,000 tons of plastic scrap. Also regarding to the violation of Duc Dat Import-Export Trading Service Co. Ltd., on 17th July 2018, the Investigating Police Agency of Hai Phong City issued a decision on criminal prosecution related to Duc Dat Import-Export Trading Service Co. Ltd., for the act of "Illegal transportation of goods across borders". The prosecution was implemented with import declaration of goods carried out by the Company at Hai Phong Customs. Previously, after the investigation and completion of dossier on violation of the Duc Dat Import-Export Trading Service Co. Ltd., Hai Phong Customs Department transferred dossiers and documents to the Investigating Police Agency of Hai Phong City for investigation and prosecution in accordance with provisions of the law. |
