On 22nd March 2017, in Hanoi, the Vietnam Chamber of Commerce and Industry (VCCI) collaborated with the Ministry of Industry and Trade to hold a seminar to get opinions and feedback of the business community on the Decree on gas trading. The seminar was much paid attention to by many enterprises in this field.

This has been the second time the State agencies decided to eliminate most of the business conditions for distributors in the field of gas trading such as tank conditions, distribution system and stations to supply gas.

However, on behalf of gas companies, Mr. Tran Trong Huu, the Secretary General of the Vietnam Gas Association said that current regulations on gas trading had still many overlapping regulations on safety conditions and fire prevention, which has caused many difficulties for both businesses and State management agencies.

Therefore, Mr. Huu proposed that State authorities should clarify legal regulations for each type of gas trading. Therefore, the authorities can easily prevent enterprises taking advantage of loopholes in the Law for commercial fraud or other violations which have been causing damages to businesses, manufacturers and consumers.

In addition, representatives of some companies proposed to supplement the regulations on price listing because this was necessary for consumers. However, this regulation should be further studied and specified, especially in commercial trading to ensure the competitiveness of enterprises.

In addition, enterprises also proposed to eliminate conditions on warehouse business; and conditions for wholesale dealers to own gas tanks and LPG cylinders.

However, most enterprises highly appreciated the Ministry of Finance’s support and modification in trade facilitation for businesses because in previous times, Decree No. 19/2016/ND-CP made many small enterprises in the field of gas trading to go bankrupt or stop operations. In particular, some regulations on safety, fire, explosion prevention and business certificates have been strongly supported by the business community to prevent risks and accidents.

At the seminar, Mr. Nguyen Sinh Nhat Tan, the Director of the Legal Department under the Ministry of Industry and Trade - the Head of the drafting committee said that he noted opinions and comments of enterprises to eliminate inappropriate business conditions. If enterprises want to continue to recommend, they may email to the Ministry of Industry and Trade to amend and supplement the draft Decree to create favourable conditions for business activities.
