Guidance to implement the procedure and exchange information on Import and Export declaration in seaports

VCN- There are many contents related to Customs procedures and electronic information exchange and connection between Customs and the port, deport and warehouses of enterprises at Sea ports under the provisions in Article 41 of the Customs Law, which are guided for local Customs in Dispatch 778/TCHQ-GSQL by the General Department of Vietnam Customs.

Accordingly, for Customs Branches which deployed information exchange and connection system with Seaports, besides implementing the contents under the guidance in Decision 1500/QD-TCHQ dated May 24, 2016 of the General Department of Vietnam Customs, they are guided to implement additional contents as follow:

For export declarations eligible for passing Customs controlled area and their containers come into port, but there have changes on checkpoint of export in the declaration to transport to another port for export, the procedures are as follow:

If the declarant requests to change the checkpoint of export for the exported declaration, the Customs Branch which store the goods and will guide the declarant to contact with the Customs Branch where the declaration was registered to amend and supplement the new checkpoint of export under provisions in Article 20 of Circular 38/2015/TT.BTC. The Customs Branch where the declaration was registered will review and approve. The Customs Branch which stored the goods will base on the amended and supplemented documents certified by the Customs Branch where the declaration was registered and provided by the declarant to enter the eligible documents for passing the Customs controlled area under the export process for the declarant to implement the procedure for taking goods out of the Customs controlled areas.

In the case where a transport enterprise requests a change of the port of loading for all exported shipments which were expected to load to exit means of transport, based on the written request for change on the port of loading for all exported shipments of the transport enterprise (in which clarifying the new check point of export, number of export declarations equivalent to the transported volume of goods), if the Customs Branch at the former check point of export accepts the case, they will instruct the transport enterprise to send information of move the container in the export declaration changing the port of loading and guide the transport enterprise to make an independent transport declaration to transport the goods from the former check point of export to the new check point of export .

The General Department of Vietnam Customs also noticed that only after the Port operator has sent the container movement information of the export declaration, the Customs officer will approve the independent transport declaration on the V5 system.

In the Dispatch, the General Department of Vietnam Customs also guided for less than a container load (LCL) shipments which are arranged in a container and transported into the Container Freight Station (CFS) in the sea port area where the container will be stored to split and arrange. The CFS enterprises will base on the number of containers transporting into the CFS in a day to issue a document (showing the container number which have goods transported into the CFS) to announce the containers which are permitted to be taken into the Station. On the basic of the announced document of CFS enterprises, the Customs Branch managing the CFS will inspect and compare the input document, if it is suitable, the Customs Branch will base on the announced document to certify the volume of the eligible container through the Customs controlled area.

Besides, the General Department of Vietnam Customs guided for specific cases: in the case of goods arranged in a transit container; exported declarations are eligible for passing the Customs controlled area and the container in the declaration which are taken into the Customs controlled area but the enterprises changing the container cover at the port due to the container cover not meeting standards for export; in the case of completing the Customs procedures the declarant want to take the goods out of the container at the port and not transport the container to the enterprises’ warehouse (and not transport the goods container through the Customs controlled area); for the imported goods cleared but enterprises do not take goods out of the port and sold for the other enterprise at the port to export.
