Dong Nai Customs Department: Control in parallel with support for businesses

Various channels to support businesses

Director of Dong Nai Customs Department Phung Thi Bich Huong said that Dong Nai Customs Department has always actively participated in drafting legal documents, given comments to develop policies and laws in the Customs field. Thereby, the unit has conveyed difficulties, obstacles and shortcomings of businesses to the Drafting Committee to consider and complete legal provisions to solve difficulties for businesses.

In the first six months of 2019, Dong Nai Customs Department issued 41 documents to contribute its comments on legal documents related to State management on Customs. They were the draft Law on Tax Administration (revised), the draft Decree amending and supplementing Decree No. 167/2017 / ND-CP, and draft Decree No. 125/2017 / ND-CP. In addition, the unit also drafted 45 documents to report problems and proposed competent agencies to revise the Customs law system such as obstacles in implementation of VASSCM system for bonded warehouses, problems in implementation of Circular 38/2018 / TT-BTC and problems of collecting environmental protection tax on original oil products and problems of C/O.

The department regularly maintains and effectively disseminates the Customs law and solves problems for businesses. Specifically, the unit has regularly updated and provided information on its website and carried out online transactions, meeting the requirements of modernizing the administration. In June, the unit updated 25 documents, thus so far there have been 6,461 updated documents. Besides, there are 332 documents updated on the internal website to serve the search of new documents related to the professional work of the unit’s officers.

The section "Online customs procedure consultancy" on its website also regularly receives and answers questions about customs procedures for businesses inside and outside the province, up to now there are nearly 22,000 questions which have been answered. In particular, in Dong Nai Customs, there is also a "specialty" that is the online System for Customs – Business Information Exchange. With this system, Dong Nai Customs Department has brought the Customs support service to the desk of business leaders, provided timely, reliable, effective and accurate information, reducing time and costs for businesses.

For the implementation of the online public service system, the unit has deployed online public services at levels 3 and 4 for 100% of customs procedures at the department and branch level, ranking 3rd in the whole sector. In June, the unit received 1,032 dossiers and processed 858 dossiers, is handling 172 dossiers (in due date). From 1 March to now, the unit has received more than 19,000 dossiers, of which 18,981 dossiers have been handled and the rest are being processed (in due date).

The Department’s subordinate branches have used of electronic documents such as electronic licenses, electronic certificates and equivalent electronic documents issued through the National Single Window when implementing related administrative procedures and the Department implements the connection with the ASEAN Single Window according to the schedule of the General Department of Customs to exchange and recognize each other on electronic commercial documents with ASEAN countries.

Strict control to create an equal environment among businesses

Considering businesses as important partners and always trying its best in supporting and facilitating businesses, Dong Nai Customs Department also promotes customs management and supervision for businesses’ operation and prevents acts of law violations in order to create an equal environment among businesses in the province. In particular, the unit regularly organizes patrol and controls at businesses with signs of losses, ceasing operations, and dissolution in order to promptly detect and handle businesses that arbitrarily consume in the domestic market or disperse free-duty goods such as machinery and equipment, imported raw materials and accessories.

Since the beginning of the year to now, Dong Nai Customs Department has detected and handled over 250 violations with total administrative fines of VND 8.3 billion. The most common violations were violations of regulations on management of raw materials, supplies, machinery, equipment, goods for export processing and production, outsourcing, leading to a situation that the actual inventory is insufficient compared to accounting vouchers, accounting books, export and import goods dossiers; failure to declare or false declarations on goods names, categories, quantities, volumes, quality, value, goods codes, tax rates, and goods origin. Typically, C.W.F Company was fined more than 1.5 billion VND, Company H was fined nearly 1.3 billion VND, A.VN Company was fined 798 billion VND.

In the future, Dong Nai Customs Department will drastically focus on resolving on-spot export declarations without reciprocal import declarations and strengthen control over imported materials. The unit will strengthen the inspection of origin for export and import goods, especially the group of unusually high-value exports, the group of export processing and production, promptly detecting methods and tricks of counterfeiting Vietnamese origin and violating labels. At the same time, strictly inspecting the conditions for application of special preferential tax rates to imported goods shipment with C/O, especially those with C/O form E, strictly complying with the contents of Circular 38 / 2018 / TT-BTC dated April 20, 2018 of the Ministry of Finance on origin of import and export goods.

Dong Nai Customs Department will also enhance the efficiency of physical inspection (quantity, type, origin, label), focusing on key goods with high value goods and temporary import for re-export.

The unit strictly controls the management of bonded warehouses under its management area, especially goods brought from abroad into bonded warehouses and then exported to other countries sharing common borders with Vietnam. Taking the initiative in organizing periodical internal inspections of the observance of State management regulations of warehouse and yard operators, promptly detecting, solving to avoid misuse of warehouses (CFS goods, domestic goods, goods in bonded warehouses). Strictly complying with regulations on operating VACCSM system, preventing cases of goods passing through the supervised area in contravention of regulations. Improving efficiency of screening and saving screening data.
