Obstructed by shipping certificates

At the conference, businesses raised many questions about specialized inspections for imported goods and asked Customs for support and removal. A representative of Grobest Vietnam Co., Ltd said, this company imports raw materials to produce aquatic food originating from animals so it has made quarantine registrations and quality inspections. The company has a certificate of eligibility for quarantine storage area, but the customs office requires a shipping certificate when the company askes for temporary release of goods to its private warehouses.

Meanwhile, the Department of Animal Health has allowed the company to bring goods to the warehouses before sampling, which means that after the goods have been brought to the warehouses, the veterinary agency take samples and supervises while waiting for the quarantine results. So what does this shipping certificate mean in this case? The company asked.

Accordingly, the company proposed to exempt the shipping certificate for shipment subject to sampling at private warehouses.

A representative of Regional Animal Health Office No. VI responded that in the past, the shipments eligible to be brought to storage had certificates for taking goods for storage granted by Regional Animal Health Office No. VI. On December 25, 2018, the Ministry of Agriculture and Rural Development (MARD) issued Circular 35, which stipulates that some goods must submit a shipping certificate to be brought to storage. However, in order to remove difficulties for business, the Office has reported to the units, they have reported to the Department of Animal Health on allowing businesses to take goods for storage when submitting certificates of quarantine to Customs.

To facilitate businesses, the Deputy Director of Ho Chi Minh City Customs Department Nguyen Huu Nghiep directed the Sai Gon port border gate Customs Branch region 1, under Circular 38, to allow businesses to bring goods to storage if enterprises submit a written inspection registration and enterprises are not requested to submit a shipping certificate according to the regulations by the MARD.

Businesses faces difficulties because goods are not on the list

Also encountering difficulties in specialized inspection, a representative of Tan Long Trading and Technical Services Company Limited asked the company imported condiments (HS code 21039029), according to section X, appendix III, Decree No. 15/2018 / ND-CP dated February 2, 2018, condiments are under the management of MARD.

However, according to section 12, appendix 1, Circular 15/2018 / TT-BNNPTNT dated October 29, 2018, HS code 21039029 is not in the "HS code table for the list of food originating from imported plant subject to food safety inspection under MARD's management scope”. Therefore, the company could not register at Regional Plant Quarantine Office No. II. Agencies under the Ministry of Health and the Ministry of Industry and Trade refused to accept the application because this was not under their jurisdiction.

Deputy Branch of Saigon Port Border Gate Customs Branch Region 1 said that based on Decree No. 15/2018 / ND-CP, this commodity is under the management of the MARD. However, the HS code table for the list of goods under the management of MARD, attached to Circular 15/2015/TT-BNNPTNT, does not have mixed condiments and mixed seasonings.

At the same time, Circular 05/2018 / TT-BYT of the Ministry of Health promulgates the list of food, food additives, food processing supplements and tools, materials for packaging and holding food subject to specialized management of the Ministry of Health also does not have these commodity.

The Sai Gon port Border Gate Customs Branch Region 1 said that the problems of Tan Long Trading and Technical Services Co., Ltd are also common problems of many businesses and have been reported to the senior level.

At the conference, Deputy Manager of Sai Gon Port Border Gate Customs Branch Region 1 Nguyen Thanh Long noted that businesses must correctly declare information on the e-manifest. If not, it will greatly affect the customs clearance time.

In fact, some cases in which businesses use shared containers and bills but do not fully declare the related declarations, so the system only confirms one customs declaration through the customs supervision area, so businesses will not make payment via banks for imported goods, if they make incorrect declarations for export goods, they will not have enough documents to carry out tax refunds.

In addition, some cases cancel customs declarations for illegitimate reasons. For example, for declarations are erroneous, belong to 1 in 6 cases that can be corrected, but businesses are afraid to correct them, so they cancel the declarations, thus affecting businesses in assessing compliance criteria. “There are cases of cancelling export declarations for the reason that there are no export goods, in this case, the companies violate the procedural policies.”
