Prevent revenue loss

Import and export goods in Binh Duong province are mainly goods for export, so processing enterprises in industrial zones have the risk of complicated factors on using drug precursors and drug transshipment, false declaration, thereby, Binh Duong Customs Department has implemented solutions on anti-smuggling and trade fraud.

As a result, there have no sign of establishing smuggling organisations and gangs. Violation cases detected over the past time are mainly through information collection.

In the first half of the year, Binh Duong Customs Department sanctioned 407 cases of Customs offences that mainly are violations on the time limit for carrying out customs procedures and violations on customs and tax declaration. The Department conducted tax assessment for 151 of 407 cases with the total tax arrears of more than VND 22 billion. The total fines and tax arrears were nearly VND 29 billion.

Through inspection, Binh Duong Customs Department detected H.V Co., Ltd transporting imported and exported goods without invoice and legal documents in Customs control area. The violation dossiers were out of the competency of the Director of Binh Duong Customs Department, thereby the department transferred the case to the People's Committee of Binh Duong province to issue a decision on administrative violations with a fine of VND 45 million and seized 109 sets of used sewing machines and equipment valued at VND 163 million and conducted an auction.

Through the inspection of J. Co.,Ltd, the department detected that the company imported and exported goods in the list of goods subject to permit but failed to present the permit. Binh Duong Customs Department imposed a fine of VND 40 million and seized infringing goods worth more than VND 2 billion

Strictly control goods origin

Customs authorities and agencies have tackled fraud cases on origin, labels for imported goods, especially acts of importing goods from foreign countries and ordering to process goods with the labels of made in Vietnam or replacing labels for trade fraud and deceiving consumers.

Facing this situation, Binh Duong Customs Department directed units to maintain a fair and transparent investment environment for enterprises.

Accordingly, Binh Duong Customs Department has directed its customs branches to request customs officers to inspect shipments and conduct the physical inspection of name, HS code and origin of goods; goods labels must be consistent with the name, HS code, origin of goods in the dossiers and origin certificates.

If detecting imported goods labeled "Made in Vietnam”, Customs officers must verify and identify the fake indications on goods origin, the place of manufacturing, packing and assembling, and depending on the specific violations criminally prosecute or impose a fine.

The Customs branches shall collect and update regularly on export and import activities of enterprises, production facilities, production capacity, production processes, export and export products. It will also make a list of targeted enterprises and goods to develop the origin risk criteria as a basis for checking and identifying goods origin to prevent and detect origin fraud of goods.

In addition, the department will also regularly update and hold training courses, instruct customs officers on regulations of FTAs, origin of import and export goods; organise business dialogue conferences to guide businesses on policies and procedures to take advantage of tariff preferences under FTAs ​​and strictly comply with regulations on goods origin and labeling.
