According to the Tax Administration Team under Zone 1st Sai Gon Seaport Customs Branch, the department is assigned to collect a tax debt target of over VND15 billion.
Determining the collection of outstanding tax debt is one of the key tasks to avoid revenue loss. Therefore, to effectively collect tax debts, the branch has provided key solutions such as reviewing the operation status of enterprises and complying with directions in Decision 2317/ QD-TCHQ dated October 24, 2022, of the General Department of Vietnam Customs.
The branch has collected tax debts and applied measures to implement tax administrative decisions in the Law on Tax Administration 38/2019/QH14; checked applications for debt cancellation of late payment interest and fines for those eligible for debt cancellation to propose competent authority to issue decisions on debt cancellation.
The branch has achieved positive results in tax debt collection, creating an important highlight in the fight against tax loss.
In the first seven months of the year, the branch collected VND35 billion of tax debts, meeting 137% of the assigned target.
The most effective measure of tax debt recovery is the issuance of suspension of exit for tax debtors. The branch issued 207 notifications of suspension of exit for tax debtors, thereby collecting over VND 12 billion of tax debts.
Notably, one company owed VND456 million in taxes since 2018. The debt arose due to a price ruling and tax assessment under the Notification of value in 2018. The branch took measures to urge and collect tax debts. However, the company delayed the tax payment. In February, the branch issued a notification on suspension of exit for the legal representative of this company. Right after that, the company fulfilled its tax obligations and paid the fine for late payment.
On July 24, after the director of M.H Manufacturing and Trading Co., Ltd. (Hiep Phuoc commune, Nha Be district, HCM City) was suspended exit for delaying in paying tax debts, the company paid the tax debts.
According to the Team leader of the Tax Administration Team, Duong Quoc Hung, the suspension of exit for the legal representatives of tax debtors has achieved positive results. This was an effective measure even for businesses with small tax debts. “The exit is the regular need of most directors, so the suspension of exit for the directors by sending the notification to the Immigration Department-Ministry of Public Security to enforce is quite effective,” said Hung.
The branch has paid attention to the tax debt collection. The branch’s leader has arranged for officers to collect debts and prevent overlapping. The collection is conducted in accordance with the Law on Tax Administration.
The branch has regularly exchanged information with technical teams to grasp information about tax debtors when enterprises have opened new declarations at the branch.
The branch has organized specialized training courses for tax administration officers to promote initiative and creativity in timely handling problems arising in performing public tasks.
To effectively collect outstanding tax debt, in the last months of the year, the branch has disseminated to raise awareness of tax compliance and tax administration for the business community through training courses and Customs-business dialogue forums.
The branch has closely monitored taxpayers showing signs of escaping and delaying tax payments to apple measures to enforce and collect tax debts.
In the near future, the Zone 1st Sai Gon Seaport Customs Branch will continue to apply seven coercive measures to recover tax debts under the Tax Administration Law, including: deducting money from accounts of tax payers subject to be enforced to pay fines in accordance with decisions issued by state treasuries, commercial banks or other credit institutions, and requesting the freezing of accounts; deducting a part of wages or income; suspending customs procedures for imports and exports; notifying invalid invoices; implementing asset distraint and auction in line with the provisions of law; collecting money and seizing other assets of taxpayers subject to enforcement of administrative decisions held by other organizations or individuals; revoking the business registration certificate, operation permit, and practice license. |
